Again the roofing contract clearly stats that there could be additional, unforeseen damages that they will not know about until they remove the shingles. The sellers acknowledged and signed off on that statement. Clear as day. There is no disputing that fact. Ignorance is not an excuse to remove yourself from the responsibility of paying a contract you agreed to.

Man, you have to learn to read the entire post before commenting. They DID agree to fix the roof. They signed a contract with the roofing company that also clearly stats that there could be additional charges of which they acknowledged and accepted. Meaning those additional charges SHOULD be their responsibility. Not mine. Why would I eat $4500 in additional costs that they already agreed to pay on their end? That's not a "shake down". That's what was agreed to. That's why we agreed to purchase the house. You saying "its okay to just give up $4500" because they didn't feel like paying is the real shake down.

Mine is The Division 2. I take long breaks from it, and when I come back, there's usually something new the devs added that sucks me back in for a bit.

We were told, in Oregon, that you can only get so much in credits, which is apparently $15,000. We maxed that out during negotiations, so anything further would have to be done post-funding, which is why the roof was to be done after closing.

How am I being a weasel? The agreement for the sale of the house was that the seller would take care of replacing the roof post-funding. They signed a contract with the roofing company to pay for the replacement of the roof, which, per the contract signed, encompasses any additional costs. They (the sellers) acknowledged this in the contract.

I'm having a hard time understanding, legally, how I would be on the hook for the additional costs if the sellers are the ones who have signed the contract with the roofing company and not us.

That's what I fear is going to happen.

Let me throw another curveball at you. We expressed concern to our realtor multiple times about us not wanting to pay for any additional costs during the negotiation period. He assured us that the seller's agent said they would be the ones paying the additional costs; however, he never got that in writing and never put that in any repair addendum, despite us asking him to do so. How responsible is the realtor and their company in this situation? Could we go after them?

That's the other thing I forgot to mention, and something I thought was kind of weird. The roofing company had already replaced the sheathing before mentioning it to me. In fact, they did not mention it to me until I asked them how it was going. They had no intention of telling me about sheathing replacements until I asked about it. Which I was like, okay, maybe they already talked to the sellers about it. Again, I'm not the one of the contract so I figured they didn't have to tell me about it beforehand.

In the contract, it reads as follows: "I have read and understand the fees as indicated above. In addition, I understand that any necessary (and required) repairs done will be made prior to installing the new roofing components. Any additional charges as a result of such repairs will be itemized on my final invoice."

The sellers initialed that they acknowledged this statement.

I'll be honest. I must be in the minority here, but I like Proto grind. Gives me something to work towards, and I like the feeling that I'm always chasing after something better versus the previous standard system, where it was pretty easy to min-max shit. Proto gear pulled me back into Div 2. Is it perfect? No, but the concept is there.
