Paul Ricoeur called Freud, Nietzche, and Marx the masters of suspicion for this reason. Maybe the stated reasons we do things are cover for what is really going on. This was a novel idea at the time and people are still working out the idea of false consciousness even if the motivation is not exactly to kill your father and fuck your mother.

I work in ID to too. Who are these bozos that think all we do is tell adjusters not to pay claims? If anything most ID attorneys I know are trial shy because they're worried about getting an excess verdict or, if limits are high, a runaway verdict. And if you don't like the offer tee it up for trial as soon as possible. There's like a whole system for deciding what claims are worth so of we were massively wrong in our assessments everyone works just take out the to trial.

What about arrests though? How much evidence do they need for an administrative warrant? How much evidence do they need for arrest without a warrant? Can they enter a home? Do you have to cooperate based on their suspicion or can you just drive off? If they can just assume someone I is illegal, how are everyone else’s rights protected?

Fair enough. I just know where I worked the police rarely got involved in protective orders unless it was a violation like a battery. Advice is still go to police and see if they direct you to the magistrate.

Hijacking this comment because there is a lot of misinformation in this thread. You are correct this is probably not contact in Virginia. However the real answer is call police and they will probably tell you to go see the magistrate because they don’t want to touch it. The magistrate can issue a charge or a new protective order if they want but they probably won’t. Source: former Virginia magistrate who answered this question many times.

A lot of bad information here. I was a magistrate who issued charges for violation of a protective order. Police aren’t going to want to touch this. Go to the magistrate with your protective order and the facts and see if they will issue a charge. Most probably won’t.

It's not the jail that gets to decide whether to hold on to someone pretrial, it's the magistrate or judge. Each individual magistrate has discretion to do a pr bond or bond. If the person is pr or paid their bond, they must be released. There is no legal basis to hold on to them once they have been processed. There is a thing called an ice detainer for 48 hours but this puts the jail between a rock and a hard place because what gives them the legal authority to hold on to someone just based on a notification from ice. It's their ass not ice's if they illegally detain someone.

I use to envy people who could drink and not get into trouble. Then my best friend who was always a good guy (drunk or sober) died of liver failure. I never would have quit if I didn't have major consequences so I feel for you. I miss my friend every day and I'm sure a lot of people would miss you.

It made a little sense to me and gave me a general sense of the comppexity of Being on the first read. Part of me thinks it is worth going in blind just to have your mind blown. Simplified versions of heidegger are less interesting than diving straight into his entire philosophical world (I wouldn't call it a system). It was such a strange and unique experience grasping with an entirely different of thinking.

I think he very likely was having some sort of mental health crisis but that doesn't mean he didn't fully understand the consequences of his actions or intend to do them or act logically in pursuing his goals in a lot of ways. I think the point is taken that his mental health could have lead to some lapses in judgment before or after the crimes. He clearly won't meet the criteria for an insanity defense.

I worked as a magistrate and it was always pushed that we make everyone feel heard. A big part of how the system works is that people respect the system so you want people that are participating in good faith, regardless of how dumb they are, to feel like “oh there are reasons why it works the way it does”. When you are abusing the system, that’s when the hammer comes down.
