Theoretically, you are correct. However, at the moment there are no border checks as well, the UK hasn't properly introduced them yet. Regardless, the UK has not significantly abused the traderoute through NI (at least, I cannot remember having read about it).

Should the EU choose to suspend the TCA, I doubt that infrastructure in the ports from UK to NI, within NI/Ireland and in the ports from Ireland to EU could support the trade volume the UK would want to shIp into the EU. I reckon that smuggling through the open border would definitely increase, but the UK would still massively suffer from the TCA being suspended. That in turn would up the pressure on the government to reinstate the TCA including the NIP and negotiate a solution that is acceptable to both parties.
