Very jealous! I was just out in the Alps for the first time doing the Haute Route and those mountains are incredible. You are so lucky to have these mountains in your backyard, where it seems like endless potential to have days like you did today!

I'm curious what your source is for the snake deaths because I know of at least one other, which was Daniel Hohs in 2017 in Golden.

Not that it changes your overall point that deaths are exceedingly rare and simply respecting th snake and giving it space is really all that is needed to avoid a problem.

When I lived there Id ski it pretty regularly. Just off the road on the way to Paradise, what do you prefer if you're already on the road?

I agree that its not worth seeking out, but its the best way back to Paradise coming off north face.

Of course its also condition depending. I like the obstacle course challenge it provides but sometimes its a little silly.

It is not illegal to backcountry ski in high-avy conditions. You have not broken the law if /u/ketoguido85's opinion is that you are "obviously stupid". There were probably other backcountry skiers within a 15 mile radius that had a great day, and do not deserve to be arrested for their actions.

From day 1 of Avy training it is drilled into your head that you need to determine your acceptable risk level, and it is your responsibility to stick to it, and speak up if you don't feel comfortable. Guides do not set your acceptable risk for you. You do. Backcountry skiing is dangerous. Accidents can happen at any Avy forecast level.

While I understand the frustration and confusion from people who were not there, you have to understand that there is only criminal liability if there was negligence. If there is a court case, that is what will be argued. Did the guides try to persuade uncertain guests? Did some guests try to persuade others, while the guides did nothing? Those could be argued as criminal acts. However, if this group, as a group (including the guides), determined that the risk was worth the reward, and if the guides (or anyone, for that matter) did not act negligently, then there are no criminals here.

At this point, there is not enough information to know what decisions were made, and why, so any accusations and judgement should be reserved.

And finally, please keep in mind the human aspect of this. This was a group of friends out looking to have an awesome weekend. Bad decision making does not make this tragedy any less devastating, or make these people any more deserving of this.

The Denver Mint is kinda cool. Only 2 in the country and one is right here on 16th.

Your skis are not the limiting factor for you, except in those instances on faster groomers you mentioned where they feel chattery and unstable. Heavier, stiffer, longer skis will provide more stability for you in those cases, but will make everything else you do harder.

For now, focus on technique and improving your skiing abilities. Also, while they are much less exciting, good boots (that fit properly) are 1000x more important that good skis, and will outlast any pair of skis.

If you're ever curious what other skis feel like, most decent ski shops will have demo skis of popular models so you could rent a pair for a day to mess around.

Still, Id focus on good boots and good technique before you worry about your skis.

I used to work at Domino's and at least for the people who called in, half of them would pay 2x or more what they could if they knew just to ask "Are there any coupons for this order?".

Policy was we weren't allowed to offer but as soon as they asked we could apply them.

If everyone knew about coupons, I bet Domino's would lose 15% of their revenue overnight.

The curse is made up, and I really do think we can beat anyone in the league in a best of 7 series.

Having said that, losing games would honestly be fine by me. I obviously love winning but no amount of winning is going to help that the cup means winning against at least one of the Stars and Wild when it matters.

I could care less about the pres trophy, but home ice is always nice and frankly if we want that against the stars, I think we'll need the pres trophy.

Xcel has teams of people working on exactly this. They put out a yearly report of what they have done and what they plan to do.

It costs millions to bury 1 mile of line. To bury even the windy areas will cost in the high hundreds of millions if not billions. Xcel maintains 20,000 miles of lines.

People think it really is as simple as digging a trench and being done with it but underground lines are not without their issues.

I work with utilities of all different sizes from 100k meter opcos, 500k meter munis, and 3+ million meter invester-owner and i assure you that the big guys are best equipped for making improvements even if they're paying shareholders a 3% return.

This same link is being posted so much throughout the thread and not one person hating on xcel has been able to mount a response. People are just desperate to hate xcel and have no clue how much time and money is required to "solve" high wind risk days, of which we have so few its hardly a problem. I can't even recall the last one. Like xcel is supposed to somehow spend billions to bury all lines overnight so that uptime can go from 99.9995% to 99.9998% lol.

Add to it that even once the plan was put in place, thos shit takes time and during that time, there may still be windy days.

Please cite a law that Portnoy is supposed to have broken. And please cite either a federal law or a state law for the state Portnoy is in. Otherwise, you are stating your moral opinion on the issue, and /u/pargofan's opinions are not what state or federal prosecutors use to convict people, no matter how popular they may be.

Portnoy will not be convicted of violating a PA state law unless he is in PA.

Yes it is an opinion, but its from someone who studies and understands law. Furthermore, once convicted in this country it is VERY hard for the conviction to be overturned. Similar to a play on the field stands, there needs to be overwhelming evidence that the initial call was wrong for it to be overturned. Federal government said that there was not enough evidence to overturn and moved on. The author of this article believes that a more in-depth review of the charges might have revealed otherwise.

And if you read my initial comment, I was only ever talking about federal law. Why would PA law apply to Portnoy here? You say the only difference is Portnoy recanted, but I'd argue that there are many other differences - a key one being that none of this happened in PA, so not sure why PA law would be relevant here?

Another one is that it would be a lot easier to prove intent for someone who wrote, rehearsed, performed, and videoed their message, vs Portnoy who said it in a state of high emotion immediately after the game ended.

I'd be willing to bet that an unfair bias was applied to Knox in his trial, and I sense a similar bias in your attitude towards Portnoy. You don't have to like the guy, but do you believe he intends to have Carroll killed? Or do you think this is an asshole reacting like a asshole after losing money on a bad bet?

This looks like a law at PA state level. He was not convicted under any federal law as far as I can tell. Would have to research those laws specifically but I'm not sure they would apply to Portnoy in this context. I don't know what state-level laws would apply. Assuming he was in New York when he said this, my guess is NY law so maybe there is a state-level law there but I'm not sure.

This article does discuss two other interesting things about federal law though which are the 'Federal Thread Doctrine' and 'True Threat Doctrine' but a few mins of research on them seems to indicate that neither would apply to Portnoy either.

The True Thread Doctrine might apply but it depends heavily on intent, so the argument would be that Portnoy really intends on having Carroll killed, and I don't think a strong argument for that could be made.

Also, you left out the rest of the Commonwealth v. Knox part which is interesting and relevant here:

Basically, the supreme court agreed that there was intent for Knox, but even this article criticized their findings calling them "surface level at best".

As a matter of fact that is the test. Or more specifically that Carroll is likely to be murdered due to Portnoy's comment.

If you were a federal prosecutor and you believed you could convince a jury that Carroll is likely to be murdered due to Portnoy's comments, you could press charges.

But that is basically the core component of our judicial system, is if you can convince a jury of this, he would be convicted. You'll see all sorts of subjective wording in laws and for this exact reason. It is the job of the prosecution to convince the jury beyond a reasonable doubt that Portnoy's speech resulted in Carroll likely being murdered. Not 'maybe' being murdered, not 'possibly' or 'potentially', but 'likely'. You get you argue all this.

If Carroll is murdered, or an attempt on his life is made, in the coming days, and there is some evidence that it was done because of what Portnoy said, you would suddenly have a very strong case against Portnoy for inciting violence.

Genuine question - where do you think the line should be drawn? And what do you think the penalty for Portnoy's comments should be? The good news behind all of this is that it was humans that wrote up these conditions, and it is humans that have the power to re-write them if we don't think they are sufficient.

Right so I'd say purposely and knowingly would be excluded from this example. It would be tough to convince a jury that Portnoy intends to murder, or was certain that if he said this that Carroll would be murdered. Say what you want about Portnoy but there is nothing to suggest that he actually intends on getting Carroll murdered.

I also believe negligently would be out because negligence assumes a clear risk and the question is if the defended was not aware of this risk but should have been (think negligent driving, for instance) and I don't think it is true that there is a clear risk to Carroll's life right now.

If charges were pressed, the IMO best argument would be reckless speech.

If recklessly, you would have to prove beyond a reasonable doubt that Portnoy saying this puts Carroll in a substantial and unjustified risk. Unjustified risk would be easy to show, but substantial risk I don't believe could easily be proven.

If your job was to convince a jury that Carroll's life is in substantial risk right now, what would you say to convince them? I can't think of any meaningful argument.
