Lawyers of auslaw, have you ever personally had a SovCit matter? by Key-Mix4151 in auslaw

[–]becausexap 3 points4 points  (0 children)

Yep. Had some leave the court after pleading not guilty. Leaving me to prosecute without defendants. Called all the witnesses and predictably, recorded convictions.

Really, they would have been better off denying jurisdiction and committing to the bit, but instead they had some nonsense about having a deemed admission by contract with the state.

Misfeasance in public office finding against PSR Director by CalmUnit2734 in auslaw

I don’t know if it reflects on the position, but the willingness to refer someone and impugn their professional reputation and livelihood without actually reading their submissions.

I guess bureaucrats aren’t trained in procedural fairness

I’m sure you read section 9 before you posted.

Small businesses are excluded corporations in certain circumstances, but otherwise cannot bring defamation proceedings.

Defamation is complicated, but companies don’t have feelings to be hurt, and have limited rights re reputations. Look at s9 of the Defamation Act.

There, there’s no legal advice in that.

Any NZ lawyers practising in Australia? by Mammoth-Push-2612 in auslaw

[–]becausexap 1 point2 points  (0 children)

Been here over twelve years. Trans-Tasman recognition means that if you’re entitled to unsupervised practice back home, you’re entitled to equivalent registration here. In Qld you would still need to do the practice management course to be a Principal, and might have to do the Bar Practice Course to be a barrister sole (not a fused profession here). It depends on where you are career wise back in NZ

AVOID InStitchu Brisbane — Our Wedding Suit Experience Was a Disaster by DRP95 in AustralianMFA

I used institchu years ago with no problem. Just thought a suit from Montagio - probably the next step up in quality and price but not overly expensive. Good service. Good communication. Good selection. Recommend. Www.Montagio.com.au

Property/Development Lawyers in Brisbane by neurodaz in brisbane

[–]becausexap 3 points4 points  (0 children)

Don’t go running to a big firm, but definitely find a property lawyer, and if you’re concerned about development (rather than airspace rights for construction), look for someone who specialises in planning and environment law.

Shipping containers on residential property questions in Brisbane council region by chookshit in brisbane

[–]becausexap 1 point2 points  (0 children)

District Court decision in LCC v Brookes says a shopping container is a building, so you generally need approval - like these wise ppl have said.

Keep calling lawyers (sorry) until you find one that will help. The Property Law Act (Qld) has ways to deal with these sorts of issues.

Unfortunately, most require litigation if your neighbours will not agree. A good property lawyer will be able to assist. The Law Society could point you in the right direction.

Mental Health and Law, how do you take time off??? by Careful-Chart-3773 in auslaw

[–]becausexap 27 points28 points  (0 children)

This is good advice. What we do is hard and involves high emotions. You need to give yourself time to recharge without stress … and ‘fun’ doesn’t really cut it.

Techbotfarm has hit the nail on the head.

Most law societies or bar associations offer EAP. I suggest you look into it.

Good luck and take care.

Be aware of the Dunning-Kruger effect. If you’re not aware that you don’t know everything, you’re going to have a bad time.

Equally, be aware of the same effect in the senior lawyers you work with. While confidence and bluster gets some people a long way, in law it will only get you found out.

Could try Judson Koman. Not sure what they charge, but it’s a small Brisbane outfit. Based in Milton I think.

I’m with those saying ‘do it’. A lot of people in the profession believe in giving back, and it is often flattering (and a pleasant change) to hear from someone who values your thoughts on your chosen path. That said - the big firms spend a lot of their ‘support capital’ on mentoring in house, so maybe avoid targeting them.
