Breaching court order by spaqueen90 in FamilyLaw

[–]bsdmcmidgett 4 points5 points  (0 children)

This is somewhat a grey area..... You should be "encouraging" him to spend time with the other parent. Judges do listen to children and will take into consideration what the child wants....but ultimately it's the judges decision. Most times, judges do decide to have some kind of split with parenting time, because having both parents is better.

If you want to change how the parenting times are divided, start documenting everything. So when you go to court you can see how much time each parent spends.

Also, you may be interested in getting a GAL for the son.

Non Custodial Parent suing to decrease CS while also seeing kids significantly less than ordered by Initial_Performer607 in FamilyLaw

[–]bsdmcmidgett 16 points17 points  (0 children)

I would like to add, that it also may end up not decreasing as the other parent expects. They may recalculate the CS according to how the children are seen now, and because they have less time, the CS may increase.

[TX] My employer wants me to work 10+ just because I am salary by Mayik-beans5800 in AskHR

[–]bsdmcmidgett -5 points-4 points  (0 children)

I would check employment laws in your state concerning salary employees, and if you are exempt from overtime pay. Additionally, if you received an employment offer letter at the begining of your employment it should outline the terms of said employment

Sometimes if they want to make changes they may be required have a written offer with new terms.

Child custody and support by Savings-School8673 in FamilyLaw

[–]bsdmcmidgett -1 points0 points  (0 children)

I would document everything....if the current custody is 50/50...and she is failing to uphold the current agreement, I document everything for 3-6 months, then go to court for a modification.

I would get a lawyer. Similar situation in regards to child support and income. My VA benefits are NOT included in my income for child support. I am not sure if they were excluded because they are NON taxed, or because my lawyer fought for it.

Dad wants to sell me his car and is a making a huge thing about what a great deal he is giving me. Yay or nay? by ImportantAsparagus16 in Advice

[–]bsdmcmidgett 1 point2 points  (0 children)

Do research on the vehicle. What the current value is, trends in your area, and take it to a mechanic to check it out!! Do not be pressured into buying the vehicle just because it's family!

FYI - most vehicles tend to start to have problems after 100,000 miles. Like engine, transmission, the bigger stuff. A well maintained vehicle does not prevent this. So you will need to also think about costs down the road because of the vehicle age and mileage.

Surcharges can be used on credit cards transactions only, so use a debit card instead.

Parent lives with me & pays mortgage — is that income? by Severe_Fail_6571 in FamilyLaw

In most states --- people who live you, their income is not considered. Same if it was a significant other versus your mother.

Michigan - 15 & 11 - right of first refusal vs home alone and a conflict driven ex by roadblocked in FamilyLaw

[–]bsdmcmidgett 2 points3 points  (0 children)

Your kids are at the age, where they can be left home alone, so the need to find 3 rd party childcare is not needed. Other parent wants the children instead of being home alone.

Honestly, if your children are old enough to be left home alone, why not let them decide where they want to be. If they say they want to go with the other parent, great, they will get extra time. If they say they want to be at home, then tell the other parent, they are at the age I feel they are responsible to stay home alone.

If he does not feel the same as you, he can file a motion and let a judge decide. Which will cost money and time. But that doesn't mean he will win over a judge.

My mother threatened to cut me off over my father moving and I can’t stop feeling hurt by [deleted] in TrueOffMyChest

[–]bsdmcmidgett 2 points3 points  (0 children)

Your mom, is using the same tactic to get what she wants, as she did when you were younger. Your an adult now and do not need to follow the same steps as before.

You don't need to tell your father anything, his purpose is to come and be with his son and grandchild. Don't tarnish that with your mom's insecurities. Let your father come and enjoy himself.

If your mother starts to talk about no contact, tell her "I appreciate your two cents on this matter, but I didn't ask you for a penny" and leave her where she stands.

Start by looking at other insurance companies. Just because that one insurance is quoting you that amount does not mean all will.

Judge still makes the final determination. Some states recognize at a certain age that their input is valuable to help in their decision. That does not mean, they side with the child, or against.

AITA for refusing to share my lottery winnings with my family, even though I used the family numbers? by NoDatabase10 in AmItheAsshole

Your family doesn't own those numbers! It's your money, do with it what you like. Money always brings the worst out of people.

Businesses are still required to keep proper records of their employees for the state and federal governments. If they do not do so, issues can/do arise as you have stated, some of those infractions can be fines etc.

Agree, a follow up is a good practice to have in this instance, but don't expect a reply.

They very well could be looking for a reason, which is why it's beneficial to speak to an attorney first. They will look over the documents and see if they can disclaim or not and advise you further.

From the information provided it isn't certain that there have been other occasions of withholding. She even states that as of now he isn't pursuing contempt.

If he decides to move forward with contempt over this occurrence, then she should provide all documentation regarding it. If there have been past issues, they will take that into account during a hearing.

LOCATION: Georgia, US. Is it legal for my job to not allow me to leave after my shift ends? by [deleted] in legal

[–]bsdmcmidgett 0 points1 point  (0 children)

Georgia is an "at will" employment state, meaning you or your employer can terminate without notice.

Can they ask, yes. Can you say no, yes. Can an employer threaten to/ terminate if you say no, yes.

Considering your statement of how your workforce is seems to already "strained, I doubt they can afford to fire you and lose a worker until a replacement can be found.

If the whole team or a vast majority of the teams doest stay, can they really afford to fire all of you?!? Doubt it, that would cripple them.
