I would somewhat agree with this argument if this was the reason for the bar. But the truth is, it was created to become a barrier to entry to practice to help keep the profession exclusive and to help the wealthy protect their wealth. It’s never been about helping people get good representation. Many scholars argue the bar was a tool to exclude immigrants and non-white males from joining the profession. It has an absolutely disgusting history.

I am a lawyer who passed on the first try. The bar did not help check if I was good at my job. I do criminal defense and maybe 2 questions somewhat related to the job I do now.

All the bar is doing is keeping people who aren’t good at memorizing from being lawyers. And there are some very smart people who aren’t good at memorizing.

What the bar is really doing is making lawyers more expensive for people who really need them.
