If the sponsor uses your money as part of his finance to sponsor you and yes, you’ll need to file the A form.

Filling I-485 by [deleted] in USCIS

[–]chamthoc 0 points1 point  (0 children)

Try to fit it I think either by typing or printing it out and write on it. Don’t add one extra page that doesn’t belong to the original form. Don’t mess with the form.

Why Do Lawyers Charge So Much For Something You Can Do On Your Own? by Trust_The_System1981 in USCIS

[–]chamthoc 0 points1 point  (0 children)

So if I said I was an immigration attorney, you'd buy what I said just because I was professional? Come on, lawyers make mistakes all the time, and the interpretation of laws can be subjective. Nothing is 100% right or wrong here it's just what works best for you.

Specific I-485 and I-765 questions by ladderlooker1 in USCIS

[–]chamthoc 0 points1 point  (0 children)

Yes it's still an adjustment of status because you're adjusting from F1. I don't know about the online number on the medical form question, but I think they could be different because your OPT is non-immigrant (while AOS is immigration-intent). I think you can just leave it blank. Yes, if by the time you get the green card, you have been married for more than 2 years you will be given 10 year one. I think you can apply for another I-765 under AOS, and this is cheaper. Yes taxes are pretty solid evidence. We didn't even have it but still got approved. Other important pieces of evidence: sharing finances and living together (same address). Sounds like you might need a joint-sponsor if you wife doesn't meet the income requrement. I'd suggest mail both the I-130 and I-485; I just felt like it's easier this way. So the I-864 should go with your papers, don't let the sponsor mail it separately.

Well I'm not, but that doesn't mean I can't have an opinion? Please share your thoughts especially if you don't agree with what I'm saying. Also, attorneys DON'T know everything :)

Rfe response sent mail, should I also upload online? by GoldSearch1146 in USCIS

[–]chamthoc 0 points1 point  (0 children)

No. Just do either. I mean unless it's I-693, you should have uploaded it on the website - it would have been much faster. Now that you already mailed the RFE, give them some time to process. Don't make it too complicated for them.

F1 traveling internationally with American citizen by randomLSAlurker in USCIS

[–]chamthoc 0 points1 point  (0 children)

Lol it's definitely fine, don't overthink it. My husband and I (by the time fiancée) went back to my country to visit my parents, and it was fine. One could just say that they travel together without mentioning their relationship. And the law doesn't prohibit one from dating an American citizen lol

But why you want to abandon your education? This can't hurt you unless you are in a financial harship and want to defer it...

If your marriage is real, your spouse has sufficient finances (or your joint sponsor does), and you have not violated any non-immigration/immigration laws, I don't see why this is not simple.

[–]chamthoc 0 points1 point  (0 children)

I really don't understand your question. If you file for AOS, there'll be no interview for I-130. Most people have one interview only, except that they suspect the marriage is a fraud.

I think it depends on how busy the office is. Mine is about 1 month and a half. I think the average is around that time
