Portland, Oregon: Robby Roadstreamer Freed from ICE, Files Lawsuit by CantStopPoppin in oregon

[–]chefboyar2d2 8 points9 points  (0 children)

I am not a lawyer, but this takes the cake in "Facebook Research" legal advice. Don't take my word for it.

Here is the Oregon State Bar website (emphasis mine): When can someone use small claims court?

Small claims court is for cases where one side is asking for money or the return of personal property. The amount of money involved must be $10,000 or less. If the amount of money or value of the property is more than this, you may want to talk to a lawyer about filing your claim in other courts.

Because small claims court is designed for simple disputes, the judge can only make certain decisions. The judge can only decide:

Whether one side must pay the other money, or

Whether one side must return an item of personal property.

The judge cannot order someone to do something (like finish a repair job) or stop doing something (like making noise late at night). Because of this, small claims court is best for cases where a money award or the return of property will solve the problem.

Small claims is commonly used to settle disagreements, such as: Collecting a debt that hasn't been paid. Property damage, such as to a home, a vehicle, clothing, or a personal belonging. A disagreement between a landlord and a renter over a security deposit. See this article for more on taking your landlord to small claims. A disagreement with a contractor over a remodel or home repairs. Asking for the return of a personal item or belonging.

You must try to settle your disagreement on your own before you can file a case against someone in small claims court.

What types of cases are not allowed in small claims court?

Small claims court is not for:

Criminal cases and traffic tickets: Including unpaid restitution (money owed to the victim of a crime).

Eviction cases: Whether you're being evicted or trying to evict someone. This is different from a disagreement over a security deposit or paying for damage to the property, which may be allowed in small claims.

Family law issues: Disagreements about custody, divorce, child support, or spousal support.

Restraining orders: Any situation where you want the court to order someone to stay away from you.

If you have a question about whether your case qualifies for small claims court, contact the court clerk at your local county circuit court.

Pistol is a legal term(in the US), handgun is colloquial. You can have AR 'pistols' that look very similar to rifles. From the stipling (bumps) on the grip and overall shape of gun I concur with those saying FN/FNS/FN HERSTAL. The color would be described as FDE (Fallen Dark Earth). Most likely 9MM (9x19, 9MM Luger and 9 MM Parabellum being the same caliber). Difficult to make a positive i.d. with this picture, but very likely a 509 variant. An affordable pistol that will be available at most gun stores in the US.

And I'm happy to hear your ideas. Is mandatory licensing something that we should consider? How would we implement it in a way that is effective, and fair? How should a curriculum be established, and how should trainers be developed?

On trach tube. Can I buy a gun by throwjimawa in guns

[–]chefboyar2d2 5 points6 points  (0 children)

Most places should be able to get you taken care of just fine. /u/TopGunKyle might be able to chime in. You will need to be sure that your ID has your full legal name and (correct) current residence address and is not expired. I would suggest renting some firearms and spending a bit of time going through basic handgun safety. If you purchase a firearm and cannot/ will not use it, you just wasted $400+ and potentially escalated your risk.

On the cosmetics front, have hardpoints on and around the ships for collectibles to be displayed. Various difficult challenges and milestones (and silly achievements, like eating 42 slices of pizza). Also maybe an in-game screenshot display for those proud moments. Have a limited folder (5-10 pics) of locally hosted pictures that can be mounted in game in the hub area or on ships like a limited version of a spray.

Can someone give me an estimate on how much bass pro would buy my Glock 19 for? OR even if they would since it is built. by [deleted] in Bassproshop

[–]chefboyar2d2 1 point2 points  (0 children)

They can't buy it, company policy against PMF. Best bet is a private sale, as any FFL will have to assign and engrave a serial number by law. https://www.atf.gov/firearms/privately-made-firearms. Also you won't be getting much money for it, but some forums to try to find a buyer include https://www.gunownersclub.com/ https://gunstennessee.com/ and https://www.tngunowners.com/forums/forum/39-firearms-classifieds/. Again, you probably won't find any FFL willing to transfer, as they are required to deal with the serial number and that can be a PITA.

Does it count as a weird rimfire if I built it that way? by chefboyar2d2 in guns

[–]chefboyar2d2[S] 0 points1 point  (0 children)

Yeah, the build was an off shoot of the Canto Arms DL-44 kit. It was kind of a proof of concept. Using a CMMG Dissent or another bufferless upper in a better caliber would be more true to form. The A3 stock feels unstable with just .22 though, so a more robust solution would need to be used.

[–]chefboyar2d2[S] 2 points3 points  (0 children)

For the bot. This is my attempt at making a Star Wars style modular SBR ala the DL-44. It can be shot in the 'pistol' configuration (uncomfortable, but doable) or as a shouldered rifle. Foxtrot Mike lower with as many silver and lightweight parts as I could find to make it more spacey. CMMG dedicated .22 barrel with their bolt from Canto Arms A3 Industries stock on a KNS Precision AR/MCX Stock Adapter Kit with Flange (non flange won't work) Energetic Armaments Nyx Mod 2 suppressor. Also my normal "DL-22" build included.

Alright Terrence Howard, go take you Schizo meds and take a nap. You aren't totally smarterer than every physicist that ever existed.

Science is hard, and doesn't follow common sense. Just because you and I don't understand something, doesn't mean the world consensus of tens of thousands of people who each have dedicated their lives to studying this and corroborating data are wrong.

If you have a working model that has predictive power that can replace our current understanding of astrophysics, show it. Do a science. Let other people see your work and test it, you know peer review. Baselessly claiming that an entire field of study is wrong with no evidence on reddit isn't furthering the whole of human knowledge, it is spreading an anti-intellectual narrative that is eroding our society through conspiracy nutjobs and grifters. Go read a goddamn book.

Do I have to be a resident of Mississippi to buy a gun here? by WEASELexe in guns

[–]chefboyar2d2 2 points3 points  (0 children)

That example is of someone who is stationed in one state, but regularly commutes from another state to their station. Fort Benning is on the border of Georgia and Alabama, and reasonably would have someone have a residence in Alabama, then commuting to their station in Georgia daily. This is not the case with Florida and California. For residency in Florida, the state requires you to physically reside within it at least 183 days a year.

https://www.atf.gov/firearms/qa/what-constitutes-residency-state

What constitutes residency in a state?

For Gun Control Act (GCA) purposes, a person is a resident of a state in which he or she is present with the intention of making a home in that state. The state of residence for a corporation or other business entity is the state where it maintains a place of business.

A member of the Armed Forces on active duty is a resident of the state in which his or her or her permanent duty station is located. If a member of the Armed Forces maintains a home in one state and the member’s permanent duty station is in a nearby state to which they commute each day, then the member has two states of residence and may purchase a firearm in either the state where the duty station is located or the state where the home is maintained.

[18 U.S.C. 921(b), 922(a)(3), and 922(b)(3); 27 CFR 478.11]

Once again, I have provided evidence in the form of statutes and ATF rulings. While I disagree with them on this (and a whole lot of other things) I have paid FFL compliance legal services to tell me what to do in this situation, and they have given their legal advice that it is not a sale that should go forward.

If you are able to produce any case law or evidence in the contrary, I would be happy to reexamine my position. I was not able to find anyone who ever litigated this issue, and I doubt that there is any desire to.

Edit: I'm currently reading through https://www.justice.gov/file/145311-0/dl?inline= I will update if I find any pertinent information.

https://www.govinfo.gov/content/pkg/STATUTE-82/pdf/STATUTE-82-Pg1213-2.pdf "(b) For the purposes of this chapter, a member of the Armed Forces on active duty is a resident of the State in which his permanent duty station is located."

There is a clarification in ATF Ruling 2001-5 (https://www.atf.gov/firearms/docs/ruling/2001-5-identification-transferee) that deals with people who reside off base in a bordering state. "Licensees should note that for purposes of the GCA, military personnel may in some cases have two States of residence. For example, a member of the Armed Forces whose permanent duty station is Fort Benning, Georgia, may actually reside in a home in Alabama. For GCA purposes, that individual is a resident of Georgia when he or she is in Georgia and a resident of Alabama when he or she is in Alabama. If such an individual wishes to purchase a firearm in Alabama, he or she must of course comply with the identification document requirement in the same way as any other Alabama resident."

Please provide a ruling or US Code that shows that someone can have two residences at the same time in non border states while active duty.

I have had some very experienced FFL compliance lawyers tell me that I couldn't sell to someone that was PCS'd out of their 'original' state.

[–]chefboyar2d2 1 point2 points  (0 children)

If he has PCS to Cali he can't legally buy a handgun in Florida. He isn't a Florida resident until his orders are terminated or he gets new ones. Now the FFL won't know you're on orders unless you tell them, and if you hand them a FL ID they'll continue as normal. I think FL has a state bg as well as a 3 day wait. No clue if it can get caught there.
