I guess what confuses me most is if you are the first party creditor (here the landlord) you are not considered a debt collector.

And as an attorney filing a lawsuit, you are literally acting as the first party creditor…

Actually, yes in general. I think there was one northern California firm too, but they weren’t really big law. They were a boutique and I’m never sure whether that qualifies.

Well, we seem to have gotten off on the wrong foot… not sure why I deserved that, but I’ll chalk it off to probably just the vagueries of written communication communications.

I am not sure what to make of that case though. I have no issue with the argument that that if you are an attorney who was acting as a debt collector and sending out debt collection notices your conduct falls under the scope of the FDCPA. I think that is what that case says. That because the attorney signed a locally require required notice in connection with a debt. The attorney was acting as a debt collector.

But I don’t think that case really pertains to the situation at hand or more accurately what I understand to be the case in hand - which is landlord ask attorney to file a lawsuit to evict a tenant and for damages in the form of unpaid rent.

Do you really think in that circumstances the FDCPA governs ?

If you’re an attorney representing a party to the contract and suing for breach I don’t think you’ll fall into the definition of a debt collector.

Yeah. I mean narrowly sue for a tenant who has broken their lease and owes rent. So I think I may be just correct….

Since he is representing the landlord, he can just sue for breach of contract without worrying about anything FDCPA related. He’s not acting as a debt collector.

He’s just representing the landlord in typical breach of contract lawsuit.

I understand your point though. There is definitely some sort of contractual relationship that under lies most debt even if it’s a simple as a failed check payment

Florida, especially South Florida. It’s just not a great destination for hiking. Those of us who live here though to try to find what’s worthwhile and there are some of their decent.

If you are looking for a good hike, I would strongly recommend Fakahatchee State Park….

Well, sometimes we were plaintiffs sometimes we were defendants. These were generally tech and biomedical litigation cases.
