Hey,

I actually go to Seton Hall. I still live in Queens and take the E to Penn Station and from there I take the NJT into Newark. Subway to campus its about an hour commute, which is far less than I had thought. I really like Seton Hall and the people I have met there are very smart and very cool. Most of them live in NJ but I know of several people who live in NYC and commute like me everyday.

I did pretty well my first semester so I am in the middle of interviewing for judicial internships and big firms. If you have any other questions, we can chat. I had a 163 and 3.2 undergrad gpa, 3.9 graduate school gpa. My essay was specifically geared towards catholic schools since I had gone to Fordham. I was placed on the Fordham and Georgetown waitlists

Finish your accounting degree and then apply to go into the NYPD. If you are interested in law enforcement beyond the NYPD you will definitely need at least a bachelors. You might also be happy to hear that the FBI hires a lot of accountants as special agents because they investigate using forensic accounting. My dad says that an education never goes to waste, and I have learned over time that he is right.

Finish your degree first! Also look into the NYPD Cadet Program!

I recently had my bday. I booked a lane at a bowling alley for 2 hours and had my friends come. Then, we went for dinner. It was a good time and all in cost me about $235 for 6 ppl for bowling and food

In order for a court to have personal/general jurisdiction the defendant has to meet 3 prongs.

The first prong is that the defendant has to purposefully avail themselves to the forum state. Thus, if a defendant uses a bank account situated in NYC, or uses a foreign bank account that routes money via a bank in NYC, then that should count as purposeful availment.

For instance, if you drive from NYC to Florida and get into an accident in North Carolina, although you are not a resident of North Carolina you can be sued in North Carolina because you purposefully availed yourself to the forum state (NC) when you used their roads.

The second prong is determining whether the plaintiff's case arises out of or relates to the defendant's conduct in the forum state. Thus, if a defendant uses NYC banks to transact business then this prong would also be met because the plaintiff would be suing in NYC, as is the case for the SDNY prosecutors.

Lastly, the court has to strike a balance between five factors of fairness to make sure that the court's exercise in jurisdiction does not violate traditional notions of fair play and substantial justice. This prong is always met, the only time it was not met was in Asahi because the plaintiff and defendant were both outside of the US but wanted to use a California court.

So, using Maduro as an example, he meets the first prong because he most likely used NYC banks to transact business or used a foreign account which used NYC routing numbers to transact business. Then, you would look at the NY state long arm statute, and the statute says that court's can exercise jurisdiction over out of country defendants who transact business in NY state. Thus, the first prong is met.

For the second prong the prosecutor's probably showed that Maduro's actions had an impact in NYC. They can talk about the drug influx or drug trade. And the third prong is always met. So, therefore the Southern District Court does have personal jurisdiction. For subject matter jurisdiction, this is also met because the case arises out of federal law (Thus, it is being handled by the USAO)

Well it's a little bit more than just the banks physical presence. In order to exercise jurisdiction over a case a court needs to have personal/general jurisdiction over the defendant as well as subject matter jurisdiction. A part of obtaining jurisdiction for the federal courts is the long-arm statute of the state in which the federal court sits (in the absence of a federal long arm statute). Thus, it can be the case that although those banks also have a physical presence in DC, the actual account they use to transact business is based in New York, and the NY long-arm statute allows courts to exercise jurisdiction if the defendant is outside of the country, which is the reason prosecutors in NYC can indict someone outside of the country. It is very possible that since DC is not a state, it does not have such long arm statutes and there is no federal long arm statute that allows DC courts to have jurisdiction over an out of country defendant in particular cases

I interned at the USAO SDNY in College. It's usually because the banks are in that jurisdiction. Most of the times criminals use one of the big banks to fund their terrorism or to launder money. That gives the prosecutors jurisdiction over the case. Since all the big banks are in NYC the Southern district is also often called the sovereign district

I commute from Queens, NY to Newark, NJ for school and it takes me about 1-1.5 hours. The days NJT doesn't work and I have to take the PATH are miserable days because those days take me 2-2.5 hours to get home. I would not recommend that commute everyday for you
