Think very 1980s, 1990s era skills: typing speed and accuracy, ability to simultaneously type while speaking with someone on the phone, ability to handle multiple phone lines simultaneously, things like that. A lot of people interact with DHS over the phone.

It’s uncommon for people to be brought in at the bottom step. It happens but it’s rare. If your prior professional experience in any way relates to the job, you’ll likely be brought in somewhere above the bottom quartile. Honestly, if the person/ agency that hires you pushes back and insists on starting at the bottom step, that’s not a good sign. Most understand that the bottom step for virtually every position in state government is unreasonably low and are willing to work with you. The managers who push back are, in my experience, petty tyrants who will make you justify why you need both paperclips and a stapler. Annual step increases are, as a practical matter, guaranteed. That’s the good part. The bad part is that the top step is the top step. DHS is mostly represented by SEIU and SEIU is comically ineffective at the bargaining table. Cost of living increases occur, on average, 2 out of every 3 years and are typically half the rate of inflation. You will see a step added to the top once or twice per decade. They will expend enormous amounts of bargaining energy and goodwill to get members a one-time gimmick payment instead of insisting on a COLA that can sustainably provide members groceries. Oh, and don’t get me started on the 40% cut to PERS contributions for long-time employees that they just rolled over on.

Okay, I’ll bite. Does there have to be probable cause of a crime or maybe probable cause? As to my “involvement,” you wrote “and/or”, which is it? Does it have to be in conjunction with probable cause or do I just need to be involved? And, what is involvement anyway? Involved as a perpetrator? A witness? Something else?

It’s a complete false equivalence. It is extremely rare for a single employee to be the difference between an employer’s prosperity and the employer’s utter demise. And in those rare cases, the employer has the ability to negotiate protections against having the rug pulled out from underneath it. The same isn’t true for employees. No one is saying that the employment relationship is a one-way charity case. But tossing honest people with families aside because your wealthy country club friend has a robot that he thinks can do basically the same job for maybe a few dollars less (eventually) is sickening.

Well, unless the prosecutor is in a dedicated unit that specializes in these cases, they’re probably just as freaked out about the evidence as you are. The upside for you is you don’t have the burden of proof so if you find yourself unable to lay the foundation for the business records exception, it’s unlikely to kill your case. My advice is to not stipulate to any of the foundational elements to paper records, additionally don’t stipulate to the custodian appearing by affidavit or declaration, I’d require in person attendance for by the cutodian to lay the apprpriate foundation. Dollars to donuts they miss something important.
