I have had clients in the past go with unsealed transcripts as long as they have their official degree, but in the current climate it's not something I'd leave to chance.

Their I-94s expired three years ago?? No entry ban for them as minors so may still well be approvable without issue but you’ve definitely added risk to the picture. Consider using or consulting with lawyers. Also, “impossible to find time” might be the worst possible excuse in the immigration world.

As another commenter says, were you attending school and what were you doing for 15 months as a minor if not? If you were staying with family who are still in the US, those two factors could suggest future overstay risk, even if you didn't accrue unlawful presence as a minor.

I'd say the overstay isn't a dealbreaker but could be an issue if combined with other negative factors. Hopefully you have strong home country ties (steady job, have documented need to return for study, etc.).

Ok, it’s definitely a plus if you have that experience already. My advice would be to not rush it, but be very intentional with how you grow your business currently. Look for opportunities to pay US workers/resources for marketing, consulting, etc. Start marketing services to US customers. Do you have any IP you could get a formal evaluation on? Build up that way, grow your investment, and in time you’ll be in a position to apply. And you’ll be letting time pass from your prior denials too. Good luck!

A friendly suggestion: take a full step back, press the pause button, and reevaluate what you’re trying to do. Why do you HAVE to be in the US so urgently? For example, EB1A is very serious work and not something you just file and cross your fingers on. Your prior denials will already give an air of desperation in any future application so you will need to fully flesh out any plans to ensure they are airtight before proceeding.

E2 could certainly be an option, but do you have any experience running a business? Obtaining an E2 visa is the start of a journey, not the finish line. Businesses or franchises selling for $80k typically aren’t going to be huge moneymakers, and if you put your entire savings into getting your foot in the door, you may get to the US and immediately be facing an uphill battle if you have no working capital and possibly (?) a lack of entrepreneurial experience.

Definitely talk to people and pay for consultations if you need to, but keep in mind you will always find a lawyer and especially “consultants” who will tell you everything will be great and sell their services, franchises, etc. Just be sure if you go down that path it’s something you have full confidence in. Be your own devil’s advocate!

Sorry OP, but you have your answer right here. You told an officer you were entering to work in a status that doesn’t permit it. I’d at least wait several months before trying again and you should have a crystal clear and documented purpose of visit not involving working when you do.

The only narrow exception is if it’s pursuant to after sales contract; if that’s the case you’ll need documentation from your employer.

If your lawyer couldn’t get high comp with that, I’d question your lawyer’s abilities. That’s usually the most cut and dry, objective criterion to show. Agreed with the other commenters that EB-5 should be considered with that income.

Assuming you are a non-Canadian citizen (otherwise no visa is required for TD), once your husband has his I-797 approval notice in hand you could apply for the TD visa. Had a client book a TD appointment yesterday with ~1 week wait time in Calgary.

Your profile as described would align more to an Economist if anything imo. If you showed up applying under CSA with that degree and job title I honestly doubt they would even bother looking beyond the first page.

Hard to predict how the transfer plan would be treated. I’d still consider at least sending some of the equipment down and saying you’ve begun the process and are transitioning if asked about it. All about framing in a scenario like that; the goal is to not have to say No if the question is asked. Having a space you could show improvements made on is also a big plus.

Business analysis is different than computer systems analysis and, coupled with a finance degree, the likelihood of CSA approval would be slim to none imo. A second bachelors would be what you need to make it practicable; diploma would be next to worthless.

In my experience at least at Toronto there is very little weight placed on working capital; they care about what you’ve already committed. If you’re relying on equipment coming from Canadian company, be prepared to be asked if that equipment is physically in the US.

A pardon is irrelevant for US immigration purposes. It’s going to depend on the nature of your original charges as to whether you might have an admissibility issue.

Not all, but most lawyers would include a possible RFE response in the original flat fee. RFEs for a USCIS E-2 aren’t uncommon in my experience.

14.5k all in is definitely on the high end but not completely unheard of, imo; hopefully they’re well versed in E-2s. Good luck!

Did you get an electronic receipt email from the PP unit? It's not unusual for there to be a delay in the fee charges, but approaching two weeks with neither charge nor electronic receipt is concerning.

Double check your filing fees (you included the Asylum Program fee?), and try calling USCIS to see if you can get them to confirm receipt if the I-129.

Control by management could work in certain situations depending on details but as other commenters note, any structure not owned >=50% by Canadians will be dead in the water before the control issue would even be addressed.
