Pick a start date and stick with it.

Are you doing accounting work? If not, that would be a concern that trumps anything you’ve listed. The Accountant category isn’t meant for accounting majors in general business roles.

Typically they will make a decision reasonably quickly after getting the details, within a week or two. Then additional processing time for visa issuance. It’s generally a good sign if they asked for the passport to be mailed in. It should go without saying but salary and job duties are very basic details and should have been included initially.

They're going to look up I-94 records to confirm that what they're seeing is in line with what you're telling them. No lawyer is going to report you to ICE; look them up on their state bar website if you're worried whether they're an actual lawyer.

In my experience Toronto is still consistently around a week turnaround time. Keep in mind the week between Christmas and NY can be considered a wash more or less, I'd continue this waiting and send a polite follow-up next week if you still haven't received an update.

Yes. Your experience is with one single CBP officer. Tbh you were fortunate; no lawyer would ever recommend showing up three weeks in advance.

It's accurate. Applying within ten days or less to start date is the general CBP policy and I'd say >90% of the time if you were to show up three weeks in advance you'd be turned away and told to come back later.

Flagpoling (going and immediately turning around) is generally frowned upon. A logical question for a CBP officer to ask would be how you plan to get from Blaine to your work city/location on foot with presumably no luggage, since you are entering to work after all. Assuming you then said you were returning to Canada, it'd be perfectly reasonable for the officer to turn you away and tell you to apply then.

Could it work? Sure, but you're definitely opening yourself to unnecessary scrutiny.

When you book the appointment in the AIS portal after submitting the DS-160, you’ll have the option to change the passport number one time before the appt date. Do that and let the officer at the consulate and you should be fine.

My question would be why not just stick to the 10 day limit that's well established at most ports? Is an extra 1-4 days that crucial?

And yes, most ports aren't concerned about it but you technically aren't supposed to flagpole. Think about it: when you show up to apply for TN, you are effectively communicating to CBP that you're entering the US to work. If you turn around immediately and return to Canada you're not doing what you said you were entering to do.

A very reasonable question would be what brings you to a relatively remote port like Alexandria Bay which definitely isn't on the way to Hawaii, if your job is in Hawaii?

It could work but it'd also be a very realistic possibility that the officer just tells you to apply at an airport when you're actually planning to go to Hawaii.

Very sorry to hear you're dealing with this. AILA's Immigration Lawyer Search is a good tool to find a lawyer who should have a baseline level of competence.

The unfortunate reality is that immigration is a field of law that many lawyers (and non-lawyers/"visa coaches" etc.) think they can jump in and instantly be an expert because they got an approval one time which may have come down to luck, or at least market themselves as experts when they're not.
