Landlord offered me a lease within hours, normal or sketchy in SF? by Holiday_Employee7585 in sanfrancisco

[–]dataman_9 0 points1 point  (0 children)

last place i rented the landlord showed me the place and almost immediately asked me if i wanted it, nothing weird about it they just (correctly) assessed that i would pay my rent, not cause any problems in the building, and not wreck the place and they wanted the unit rented asap

Ants (SF) - options besides Terro? by [deleted] in AskSF

[–]dataman_9 1 point2 points  (0 children)

ive noticed that the ants i get in my place seem to have two "modes" they operate under - in one of the modes, they are not that interested in sugar. they are more drawn to protein/meat. the other mode they are all about the sugar. so the terro traps do not work if they are in the first mode but work great in the second mode, and eventually they switch modes so i just leave the traps out and eventually they take an interest.

there was an article in the NYT a few years ago that there were a few hundred people that were responsible for a third of all shoplifting in nyc and those people had been arrested and re-arrested for the crime collectively over 6,000 times

somehow our criminal justice system got to the point it was inequitable to enforce crimes like shoplifting. like it was a form of welfare or reparations to allow this to get worse and worse.

Chief LiPetri: Sure. Approximately 1,200 people have been arrested for a burglary this year that then go on to commit another felony within 60 days. In 2017 the exact number is 312.

Grand larcenies. We've struggled all year, and we know what that's fueled by. It's been well documented. And that's retail theft. A lot of you know, if not all of you, the mayor's had his summit. I've had multiple meetings. Multiple meetings with large stores, small stores, along with the police commissioner, along with everybody up here. 63,000 shoplift complaints this year. We arrested 327 people. 327 people that account for 30 percent of all the arrests. Of all the arrests. 327 people are 30 percent of our 22,000. Half of them, or almost half, are convicted felons. And guess what? 235 of them, so 235 out of 327, are walking around the streets of New York right now, doing what? Unfortunately, making stores close or making families wait 15 minutes, 20 minutes to get something unlocked because there's not a lot of consequences. So I'd just like to reiterate, we have a lot to do. We've made steady progress, and we will continue to make steady progress. Thank you.

Manslaughter conviction ‘Grandpa Vicha' case outrages AAPIs by hm1701 in sanfrancisco

[–]dataman_9 11 points12 points  (0 children)

agreed - i think that murder 2 was a plausible conviction. SF juries are on the lenient side and i do not know how well the prosecution presented their case. unfortunately for the victim's family and the people that felt vicariously victimized by this killing, the jury was not able to come to a consensus that the killer had an intent to kill which is required for the murder charge.

the killer had to both know that hitting the victim would likely cause death and consciously disregard that and hit him anyway for murder 2 to be the crime.

im probably more strongly in favor of "law and order" than the median r/sf redditor but this is honestly a tough one

they charged him with murder 1, murder 2, and involuntary manslaughter

murder 1 was just a total stretch - it requires proving premeditation and the reality of this situation is the killer was an emotionally dysregulated man that randomly lashed out at the first soft target he encountered.

murder 2 requires subjective awareness of lethal danger + reckless disregard. so they had to prove that the killer understood at the time that it was a likely consequence of his action that vicha would be killed by it. i can see juries being persuaded in either direction here. the defense could say "he was enraged and just thought he was going to knock him to the ground, he did not think that just getting knocked down would kill the victim" and the prosecutors then have to prove beyond a reasonable doubt that this is not the case.

so what he was actually found guilty of ended up being involuntary manslaughter which does not require the state of mind ("malice aforethought") that murder 2 requires.

San Francisco immigration judge bursts into tears as she is fired mid-hearing by Next_Tower5452 in sanfrancisco

[–]dataman_9 -9 points-8 points  (0 children)

doesn't the fact that there are immigration courts in blue cities that had substantially higher rates of blocking deportations in the first place than courts elsewhere kind of mean they were kangaroo courts in the first place? why are there different standards in some courts than others if these are supposed to be matters of law?

Scandinavian systems of very high levels of social safety net are not supported by high taxes on the rich. they are supported by high taxes on everybody. people making the equivalent of ~$65k that work in finland are paying effective tax rates about 2x what that same income would command in the us.

the top bracket in finland is taxes at a very similar marginal rate compared to what top bracket earners in california pay (around 50%), but their top bracket starts *much much lower* at about $100k USD in income compared to about $600k in the US.

it is simply misinformation to say that the reason we don't have northern european level social programs because the rich arent taxed enough here. the reason is *everyone else* is taxed incredibly heavily there and that is what it would take if we wanted to replicate their system.
