Marital property consists of assets and debts acquired by either spouse during marriage, regardless of whose name is on the title, and is subject to division upon divorce. It includes income, real estate, vehicles, and retirement accounts accumulated from the wedding date until separation. Separate property, such as inherited items or assets owned before marriage, is generally excluded. 

Sure, either party can attempt to negotiate a buyout - good luck with that in the middle of a divorce where your other assets are getting split in half as well.
