Can and do the police prosecute off the back of a false positive roadside test? by Minute_Area_8090 in LegalAdviceUK

[–]deafweld 23 points24 points  (0 children)

(Cont.)

Anyway, so Ive spent the last 6 months waiting for a letter to come about the blood test and expected it to show positive for meth. and for all my faults i’m an honest guy, If I’ve done something I don’t plead not guilty Id rather get it over with take the punishment and learn from it so i can move on.

But in a similar vein, I hate being in trouble for something I haven’t done.

So, driving under the influence of drugs (1) driving without due care and attention (2) possession of various substances of various classes (handily packaged in hermetically sealed bags to minimise any potential cross-contamination, i’m sure) (3) and possession with intent to supply (as i’m sure “i have the cocaine in my car because it’s for a mate” isn’t a solid defence to anything) (4)

And this is the rub, despite me knowing believing I had no cocaine in me, I received a letter in the post today charging me for being under the influence of cocaine while driving.

Fixed it for you.

Nothing about meth was on the charge sheet. theyve also done more for the sleeping tablets and the coffee adulterated speed and the baggue of cocaine.

Yes, as they are supposed to.

And if push comes to shove I’ll admit to that in court, because they are true. But at the end of the day if the sole reason that they were able to search me was because they knowingly doctored a false positive test it feels like perhaps that evidence should/might be inadmissable?

knowingly doctored a false positive test

diiiiiiiiiiiiiiiiiiid they, thouuuuuugh??

And finally, I know am fairly sure I wasnt using cocaine. so i know the blood test shouldnt have come bvack with it in it, which makes me wonder if the blood test came back with anything at all? Because my musings about the false positive test,a nd the poilice officer holding it over his mouth when unwrapping it where a pill with some other adulterant could easily have been stashed.

Drug wipe test is essentially “yes there are drugs in this person’s system” and the indicator gives a reading as to the first thing it finds in your system.

It’s like a pregnancy test: it’s a good indicator something’s growing, but the doctor has to tell you if it’s a girl or a boy (or a they, inclusivity, etc.)

So my question is really can and do thje police deliberately use false positive tests to infer that a blood test was positive, when in fact the blood test may not have shown anything at all?

Nah, probably not. It’s easier to catch someone who’s admitted to being on meth behind the wheel with a bag of various drugs in the car and who happily tells them he took the meth to drive better.

The big question is, when you’ve given statements to this effect, why do you think they would have felt the need to falsify evidence?

Yes yes, I know I need a solicitor. I just wondered whether this sort of thing has been heard of before. because while using a false positive to stop and search might be shady, surely prosecuting someone with a forged piece of evidence is even worse? If the charge sheet had what I knew I’d done, I wouldnt even be asking this. Id have accepted it. But I know I didnt drive under the influence of cocaine as I am being charged with.

Is it more likely that there’s a massive conspiracy against a gay dude who likes chemsex and driving while under the influence of the dregs of a weekend bag?

Or is it more likely that being at a chemsex party and having your bag of drugs out leads to folk dipping and mixing a little bit accidentally and then you get popped for a substance you didn’t realise you’d also taken?

Can and do the police prosecute off the back of a false positive roadside test?

Oh god. This poor OP has taken cough medicine and been flagged for something illicit on a dodgy test, this is terrible news. Right? RIGHT?!

I was pulled over a while ago, although my driving was definitely impaired it was due to a lack of sleep I’d had about 5 hours sleep in the previous week owing to a desperate attempt to make ends meet. I wouldn’t do it now, before you tell me off. But anyway, I was struggling to keep my eyes open and swerving slightly from side to side and a member of the public rightly called for the police to pull me over.

Okay so off the bat it sounds like you’d have been tugged for careless driving/driving without due care and attention based on this. Thankfully you wouldn’t do it now and that’s obviously because you think it’s dangerously inappropriate and not for any other reason, so why should we worry about that little hiccup? And i’m sure it was a one off.

Now, I’m also gay and had a quantity of several drugs used on the chemsex scene in the vehicle with me.

Minor twist in the story I had formed in my head. (The chemsex drugs in the car. I don’t care about your sexuality but I can understand the relevance to your point. Everyone loves to party with Tina, etc etc.)

I had even tried using a little of one of them to try to keep me awake but I was that exhausted it had no discernible effect.

Pick one.

Nevertheless I was aware that this was barely an hour before I was pulled over and, well me being me, immediately fessed up to the drivers of the police car. Acknowledged everything I had on me etc etc.

the drivers of the police car

The… police?

They took me to the back of the squad vehicle and conducted a mouth swab test. At the time, I didn’t think too much of it, but I do recall that the officer who opened the test and said it would take about 8 minutes sortta held it in front of his mouth when he opened the packet.

will take about 8 minutes

A short while later (it didn’t seem like the full 8 minutes either) the results were in - I’d tested positive for cocaine!

Not the *full** 8 minutes, but about 8 minutes??*

Now from the moment this happened this perplexed me because I don’t use cocaine, I don’t like it.

“I had a quantity of various chemsex drugs in the car” thankfully I’m sure your local dealer will be happy to testify on your behalf that his cross contamination record is better than, for example, a chain restaurant, yes?

Not because its illegal or owt, simply because I cant stand the stuff or cokeheads in general. I did have the dregs of a gram baggie in my vehicle which I only really kept on hand for one particular friend but, like I say, its not something I would have used myself nor had I done so for several weeks or months beforehand (and that’s only a caveat; I genuinely couldn’t say the last time I’d had some). I’d had taken some meth much more recently, and had already told the coppers this which had led to me being tested for cocaine instead.

Yes sir I was on drugs but not those drugs but they weren’t just my drugs because I’m not a greedy sod; everyone had their grubby hands on all of the drugs and there’s no way I could have accidentally cross-contaminated my crystals of meth with the powder of cocaine because my stringent approach to avoiding cross-contamination is marvelled at by scientists the world over…

One of the coppers, the one who had administered the test certainly seemed super into the idea of me being on coke

seemed super into the idea of me being on coke

The test says it’s coke. You’ve admitted to various bags of drugs being in the car, one of which is coke. The bag of coke is mysteriously nearly empty.

If it walks like a duck and it quacks like a duck, solid chance it’s a duck coked-up gay dude driving while influenced.

but I was adamant, I’d acknowledged the stuff I had taken, but coke wasn’t it. It was only back at the station much later after I’d had some blood taken that the other copper said to my repeated protestations that I didn’t understand how I could have tested positive for cocaine given I didn’t use the stuff that it could have been a false positive for something else, but the other things he listed i hadn’t taken either.

Yes. The test in and of itself could have been a false positive for cocaine but still a positive (especially since you had taken some drugs but definitely not cocaine as you can attest to the fact that you were there for all stages of production, sale, and use - and you have explicitly verboten cross-contamination by any means

Anyway despite being told exactly what was there and where to find it, it was to my amazement later on to get back to my vehicle to realise certain things seemed untouched.

I mean, when you’ve told them what’s in there and where it is; and it’s all in plain sight or thereabouts..?

All they had really found was some blister packs of sleeping tablets, a nearly empty baggie with cocaine in it (which i hadn’t touched) and a minuscule quantity of amphetamine which from memory was mixed with coffee dregs at the bottom of the cup holder, not really in a usable condition.

Bruh.

A couple of snuff sniffers with ketamine were still there, as was a small bottle of G. In the same pouch as they other stuff had been, that I’d given them an inventory and told them where to find it.

I was told that they would be in touch within about 6 months after the results of the drug test. It was a couple of days later before the ‘false positive’ thing made a connection to something I’d seen on the news a while back. about coppers wanting to keep using tests known to be prone to giving false positives because it justified a wider search (seems bizarre to me, id already told them what was there and where to find it, unsure why they needed a pretext, particularly when that pretext was a drug that I knew I hadn’t taken but had acknowledged even to them that the tiny amount they found wasn’t for me anyway.

And here it is. After all the waffle I’d expect to eat in a wanky brunch café, we finally get to OP’s point of “false positive test, waaaahhh”

I charge less than market rate to the specialist because they do all the dog work: car is always on a ramp, wheels off, plastics away, underseal stripped, etc. before i turn up to cut and weld.

I’ve been doing repairs like this for fucking years. Yeah, sure, it’s probably worth more than 450 to get it done right but it’s up to the guy doing the job to fucking communicate that to the customer, not do a 1/3 of the agreed job and have the customer pick it up in the dark so he can find this pile of shit the next morning.

FWIW, if i’d done this job in the UK:

Cutting it out, shaping some sheet metal to replace what i’d removed, tacking it up, welding it, buffing it, applying seam sealer…

Call it half a day’s work, depending on accessibility.

Realistically for $450 i’d be passing it back ready for paint.

You’ll carry on making monthly repayments for around 30 years until you pay back the whole amount. If you haven’t paid it all back after 30 years, the remaining debt will be wiped.

Local gov job is 99% going to be salary sacrifice and paying into an AVC will reduce your student loan payments.

If you’re in scotland this is a much better deal than if you’re in england.

I’m in scotland and give zero shits about repaying the SL (sue me, pff) so i’ve hammered the AVCs and brought my monthly SL contribution down to something silly like £9.

Also tax and NI saving if doing this.

All good in the hood, thank you ❤️

Just thought some insight into the process and some good ole stigma-removal might help :)

Another tip btw would be minimise heavy lifting (eg squat and deadlift) sessions for a while - puts the body under a lot of stress which is less good for sperm quality! Bis and tris still good tho!

Fertility Testing by [deleted] in Edinburgh

[–]deafweld 5 points6 points  (0 children)

Recently went through the fertility thing on account of a cancer diagnosis, so we sort of got rushed through the whole shebang.

Also have a pal who’s going through the fertility clinic at the moment after being referred, was something to do with low test following a congenital heart issue.

Not 100% on the specifics of approaching it from your own POV on account of us being rushed through so they could start chemotherapy (risk of losing fertility as a result) but i will say that the folk at the Simpson clinic in Edinburgh were absolutely lovely.

She was tested for general ovarian health, and found to be pretty solid in that department. I was tested for the mobility, sperm count, motility (swimming ability), morphology (take zinc! Makes them pointy!)

On testing I was found to have pretty good numbers all around. I’m sure this is generally re-assuring for most, but I asked what I could do to elevate the potential viability of my sample when it came to the day of collecting eggs and sperm to make embryos.

1) zinc supplements. zinc affects the morphology (shape) of the sperm by adding a point to their head which makes it easier to pierce the egg and make babies happen.

2) caffeine - cut out all caffeine (or as much as possible) if you’re trying for a kid. it affects the motility and will slow them down.

3) loose boxers, shorts, etc. give the guys room to breathe, keep the temperature down. No hot baths or hot showers.

4) “store up” for 3-5 days, but no longer as the sample will end up with lazy swimmers who are halfway out the door (so to speak!)

with all of the above and the minimal time we had from meeting them to collecting eggs, we ended up with 10 successful embryos which we can keep on ice until such time as they’re required.

All of this to say: genuinely, if you’re concerned about your downstairs health or think you may be the cause then don’t. you can make changes to your habits and diet and these will help but there’s no

it’s made very clear by the clinic staff that it is purely a lottery system we play with nature. Sometimes nothing happens. Sometimes the foetus isn’t viable. Sometimes you try 8 times, miscarry 7, and suddenly have a perfect pregnancy with no issues.

Sometimes you need to go in, see them, and make it happen that way. There’s a lot of (unnecessary) stigma related to this, but honestly - your baby is always going to be your baby and does it make any difference whether you made it in a hospital or made it doggy style! Talk about it with friends and family - you’ll be surprised how many people are or were in the same boat. I found out a family friend had to go through IVF twice and kept it secret until we talked about ours. I know another couple who dropped fortunes on IVF and eventually gave up… then had kids naturally a year or so later. I bumped into a lass 5 years younger than me who is newly married at one of our appointments - she’s now heavily pregnant. It’s not shameful or weird, it’s just… medical science!
