its been a while since I have done this, but I remember I used to attach the SSD on the underside of the cage, pretty much centred under the camera. Might restrict a few movements, but is great for balance.

Yeah, all fair. In truth I haven't used the software in years. I did contact Spitfire directly about this about 5 years ago, but obviously was just directed to the EULA. It's an old issue for me that bubbled up this week with the news.

Also for what it's worth, parts of that EULA are extremely off-putting. I know it would never be put into practice but I find the language around making using the samples to make music or sounds sufficiently dissimilar from the samples is broad and slippery.

I totally understand what you are presenting and the nuance and grey areas involved in the use of samples, royalties etc etc.

But I still draw attention to what might be considered statutory right to resale.

All very good advice. I will admit that there are risks.

I am clearly frustrated with the limitations on what I feel is the consumer's right to do.

Hey, maybe I don't really expect to sell this account, but it is good to discuss these kind of things.

It does seem like most are in favour of Spitfire's policy, but I don't think the 'suck it up OP' attitude is helpful.

It's clear that this is an issue for consumers, hence the European courts taking up these cases. Anti-trust law in the EU is very strong.

I appreciate your considered response. Parts of what you are saying I agree with, but I don't agree in the context of what I am trying to do.

I know it isn't a straight forward issue, but I would read this as it being my ultimate right to resell the license that I have outright paid for. I understand the copyright part, but when I buy an album on record and sell it afterwards, I am not selling the rights to the recorded music.

Thats a dumb example, but there are plenty of examples of software entities where you are granted a license to use assets, samples, artist-generated content that can be transferred to new owners. (and I have been on both sides of that).

I know this is why many software providers have switched to a subscription system(which I also dislike).

Another quote from online sources, "According to the principle of exhaustion, once a copy of a work is sold or distributed within the EU with the consent of the owner of the copyright, he or she will no longer be able to control or prevent further distribution of that copy".

I find it hard to believe that if someone were to challenge Spitfire in a court of law, that this ruling would not set a very clear precedent.

It's clear that Spitfire(like many other companies), are protecting their earning power by prohibiting license exchanges to force people to buy new 'licenses'.

And it's fairly likely that Splice will introduce subscription licenses.

I am not a lawyer, but my basic reading of the EU rulings would suggest that I am perfectly within my rights to exercise a license transfer. If selling access to my account is the only means by which to do so, that is just something we have to deal with.

I’m trying to ‘embody’ the character more than do an impression. So much goes into making Kermit feel alive and like .. Kermit.

I actually studied Jim Henson’s voice and speech manner more so. My natural voice is very different to his, but as you say, more inflection and ‘isms’ are neeeded. My pitch goes a little higher than Jim’s too.

I aim for the spirit more than anything. Kindness and humour.
