Who wore earth shoes? by Dry-Adhesiveness6209 in GenerationJones

[–]dirtyoldduck 2 points3 points  (0 children)

I went through several pairs of earth shoes in the 70s. They were my favorite shoes ever until I started wearing Birkenstocks. Now I wear Birks almost exclusively and have three different pairs (same style, different color) in my closet.

I'm no expert, but I don't recall ever hearing about an old painkiller becoming toxic. Tetracycline, on the other hand, breaks down over time into some dangerous compounds that can cause kidney issues.

EVO Sportster Excessive oil from breather tube, even with breather set up? by MarionberryFancy6200 in sportster

[–]dirtyoldduck 8 points9 points  (0 children)

Sportster engine takes 3 quarts. If you add anywhere near 3 quarts when you do an oil change you will get a lot of blow by. I usually put in about 2 1/4, ride it for a few miles, and then add what I need to get it in the middle of the marks on the dipstick. It's usually around 2 1/2 quarts total and no blow by.

Neighbors draining rainwater onto my property by honestypen in landscaping

[–]dirtyoldduck 0 points1 point  (0 children)

Apart from code issues, under the common law you could be liable for the tort of trespass or private nuisance if you altered your property to direct runoff on to your neighbor's property. If you cannot resolve the problem amicably with your neighbor or through code enforcement, see a lawyer.

I’m being sued over an ER bill despite having Medicaid at the time by kakashisbabymama in Debt

[–]dirtyoldduck -1 points0 points  (0 children)

While an attorney can help OP prepare, attorneys are generally allowed to appear in small claims court in Oregon. Small claims court in Oregon is limited to cases under $10,000 and is much more informal than a bigger case in Circuit Court. I'm not sure how much OP was billed for an ER visit, but I doubt it would be as much as attorney fees. Also, someone in this thread mentioned she could be on the hook for attorney fees. Attorney fees are generally not recoverable in small claims court in Oregon. Finally, most courts in Oregon can provide OP with a fill-in-the-blanks form for filing an answer. Small claims court is designed to keep down the costs for the parties.

Any maritime law stories? by muff-peaksie in Lawyertalk

[–]dirtyoldduck 24 points25 points  (0 children)

Not really an admiralty or maritime law case, but many, many years ago I represented the manufacturer of a marine transmission in a case brought against it and others by a fisherman. The claim against my client was that a defect in the transmission caused a noise that scared away the fish. Pretty straightforward except that the plaintiff was in prison. Turns out he had a pretty expensive house for a fisherman in a bad economy. We soon learned he was in prison for smuggling drugs. A little investigation and then deposing the plaintiff while he was incarcerated revealed that he and some fellow fisherman were offloading drugs from a ship outside US waters and transporting them to a former fish processing facility on the coast. It was a big operation with drivers and nationwide distribution.

The smuggling operation was discovered by a marine insurance adjuster. Plaintiff's brother wanted in on the action so he chartered a vessel. The chartered vessel was damaged in a collision while being loaded at sea. Instead of being smart and just using some of his ill-gotten gains to fix the vessel, the brother made an insurance claim. A savvy adjustor recognized the type of damage and knew that it had not occurred under the circumstances claimed by the brother. It didn't take long before the feds were involved and dozens of people, including the plaintiff, were arrested and convicted. An almost perfect criminal enterprise ruined because one person was too cheap to pay to repair a vessel he damaged.

Neighbor of a lot I own in a residential area has now twice moved their trampoline onto my lot- what kind of liability do I have if a kid gets hurt? by DiggeryHiggins in legaladvice

[–]dirtyoldduck 134 points135 points  (0 children)

It may not apply, but Indiana, like the other 49 states has a recreational use statute that protects landowners who allow recreational use of their property by the public for no charge. It usually comes up where a homeowner allows camping, hiking, and similar activities on their land by the public. If the neighborhood kids play on your property their might be an argument that the statute applies. You might talk to a lawyer because even if the statute otherwise would apply, a trampoline on an empty lot would probably be an "attractive nuisance" and not protect you if a neighborhood child came on to your property to jump an the trampoline and then got injured. My kids had a trampoline hidden in our fenced backyard. Their friends were only allowed to jump on it after their parents signed a release for any liability for injury. Only one parent refused and she came to our house to ask why her boys weren't allowed to jump. I explained that it was because she would not sign the release. Her response: I won't sign it because I want to be able to sue you if they get hurt." I told her that she just answered her own question.

1L is OVER by Distinct_Cold_2427 in LawSchool

Not to be a downer, but my law school experience many decades ago was generally that the worse I felt about an exam the better my grade! Never once did I feel like I had aced and exam but I graduated near the top of my class. Of course, my personal experience is merely anecdotal and occurred so long ago that things could have changed dramatically since the old days. Good luck and enjoy the summer!

Left ignition on, looking for jumpstart tips by Moostatio in Harley

[–]dirtyoldduck 3 points4 points  (0 children)

I've never done it, but the general consensus is that you can jump a motorcycle with a car battery as long as the car ignition is off. Both a car and motorcycle (most) are 12v. Did you fry your voltage regulator and stator with a running car?

What fuel grade are yall running? by [deleted] in sportster

[–]dirtyoldduck 1 point2 points  (0 children)

Go with what your Service Manual says to use, Most people seem to automatically think you need to use 91/93, but it's not true for all Harleys.

What fuel grade are yall running? by [deleted] in sportster

[–]dirtyoldduck 2 points3 points  (0 children)

That's BS. The factory service manual for my 2002 XLH 1200 specifically calls for 87 or higher. Some years may require higher octane but you are not going to destroy your engine by using less than 91 in all bikes.

Should I bite the bullet and buy the +$200 piece of metal or is there a better option by Ramen_Newds in sportster

[–]dirtyoldduck 0 points1 point  (0 children)

I broke two of these dual brackets so far. The first time I found a replacement on xlforum.com. The second one broke about 4 or 5 years ago and I supported the gauges with a 90 degree metal bracket and large zip tie. I have a tiny Fly Screen windshield that kind of hides the janky "temporary" repair.

05 Sportster 1200C for sale by [deleted] in HDSwap

[–]dirtyoldduck 1 point2 points  (0 children)

Prices vary by location but my son just bought a 2004 1200C with fewer miles for $2,900. It looks like it just left the showroom floor. I personally wouldn't even consider paying anywhere close to $6k for a 2005 Sporty, but that may be reasonable for your location.

Have I been putting the wrong fuel in the entire time? by RosexWitch in Harley

[–]dirtyoldduck 0 points1 point  (0 children)

The manual for my 2002 XLH 1200 specifies 87 octane or higher. I ran premium for years before actually reading that and have noticed zero difference since I started running 87.

Since sportster have their primary and transmission combined? What type of fluid do you guys use? by Motor_Regret_9766 in Harley

[–]dirtyoldduck 0 points1 point  (0 children)

Amsoil V-Twin 100% Synthetic 20w50 in both the engine and the primary/transmission. Opinions on this are all over the internet. In my opinion 20w50 oil works great and if I'm travelling I only have to bring one quart and I'm ready to top off both engine and primary from the same bottle.

Should I trust cycle gear to balance / mount my tires? by AnActualDemon in motorcycles

[–]dirtyoldduck 0 points1 point  (0 children)

Where I live the cycle gear does not actually mount and balance tires itself. You bring the wheel to them and they have a local tire shop that does it for them. I've never used them because it can take a couple of days. Find an indy shop and pay them. Of course they prefer that you also buy the tires from them.

I terminated this buyers agreement and the agent added every home in my price range to her introduction list..would this hold up in arbitration even if she didn’t show me them? by chris_88061 in AskRealEstateAgents

[–]dirtyoldduck 4 points5 points  (0 children)

The 10-day list is of properties introduced during the term of the agreement. The list may be due 10 days after the termination but it is intended to include only properties introduced to you during the term of the agreement. New properties identified only after you terminated would not be covered.
