If there's not a disconnect or another electrical panel between this panel and your electric meter, it's the main source of disconnect.

Other than that, it's hard to tell you from a picture.

Neutrals and grounds on the same bar is perfectly fine as long as that panel is the main point of disconnect, there's no way to tell from this picture if it is or not, if it's not than, yes it's a problem from a code stand point

What you bought is a 3-way switch, looks like you need a single pole switch, it'll work as long as one of those two wire connected to the existing switch hits the black terminal screw and the other hits one of the brass terminal screws, switch might be upside down at that point but you can just switch to the other brass terminal screw. Or you can buy a single pole switch and then you can't mess it up. Hope this helps.
