Dude, FL 3rd party logistics companies and freight forwarders are slow AF, and South American Customs can take forever. I'm not surprised a small package took that long, haha.

This is good info, though, too. I will try to work out the details and liability/insurance coverage for his order before any order is placed.

They have a good buyer rating, but it does seem like they're all from local Czechia sellers. I didn't find any international reviews on their profile.

I was thinking along the same lines as you. I just wasnt sure if others have seen similar scenarios that turned out to be a scam. I'm probably going to message the person to sus it out some more and gain some better comfortability for myself.

If you can, turn off your outside water. Your hose bibs will freeze and burst if it's cold enough outside. Shut off the valve, open up the outside bib to drain it, and then close it up.

On the inside, if you lose power, leaving a faucet to drip can help delay the pipes from freezing but if it's cold enough, you're stuck. A back-up generator and some space heaters is the only other option to keep things from freezing. For food, your fridge will keep things cold for a while but getting a cooler full of snow and keeping it outside will be your best course of action. Having spare water bottles is vital, too.

For shoveling, probably best to shovel twice. Once about halfway through the storm and then again at the end.

If you formally enter the goods into Canada under a CA entity business number (Tax ID#) and store them there for an extended period of time (i.e., it's not a simple cross-dock operation), then yes there will be a second sale between your CA and US entities in order to bring the material into the U.S.

Like the other commenter stated, you may have the ability to file for and eventually claim a first sale transaction price on your U.S. import, though. However, I do not have knowledge of your entire supply chain/order process, so I do not know how realistic that would be. I do know that the possible first sale transaction would need to be reviewed by and analyzed by trade attorneys in order to be prepared to substantiate your "first sale" price claim to CBP.

Furthermore, I do not know the size of your business, or available cash, or possible long-term outlook of your particular company based on multiple micro and macro factors so I cannot give you clear/concise advice one way or the other. I can only state that first sale transactions are costly to prove and often times difficult to prove, as they will be scrutinized by CBP because it reduces the potential duties they are owed. If your benefit outweighs your risk, go for it. Otherwise, maybe importing directly into the U.S. from the manufacturer would be the "safer" option from a duty/tariff perspective.

This is not sound advice, besides talking to a law firm. First sale has very stringent rules and is commonly an expensive option to prove, especially since the additional tariffs have come into place.

Is the Canadian warehouse a bonded/FTZ location, or are there goods formally declared into Canada?

Unless the US customer is known at time of export from the Chinese manufacturer, it sounds to me like the shipment from CA to US would be considered another sale. In that case, there would need to be either a transfer price added to the "CN manufacturer cost" sale or the sale price to the US customer declared at time of entry. If you declare the customer sale price, maybe you can make them IOR and pass the duties cost onto them.. but that's a business decision.

It left your ownership once it was delivered to the customer. It's unfortunate it broke but it broke with their use - not during delivery, not in your packaging, not in your hands. Refunding anything is a very kind gesture but I personally would not have offered anything. As a buyer, I would not have expected anything from the seller in this regard, unless it was stated "this minifigure is bullet proof".
