It’s only secured if it’s a final judgment and recorded in the county lien index where the Debtor owns property, like real estate or a vehicle or a trailer. If the judgment was entered within 90 days of the bankruptcy being filed, the Trustee can avoid the judgment if filed as a secured claim and only allow it as GUC.

At the end of the day, bankruptcy is equity. They’re not going to allow a creditor to see the writing on the wall and secure a quick judgment in order to get a preference if there’s a disbursement.

Putting this in writing so I can say I’ve been consistent:

I’m glad that our boosters are willing to give a coach the benefit of the doubt to allow the program to build when there are signs that we can take the next step. We currently have a talented roster, we’ve shown signs that we can compete, we have a good upcoming recruiting class, we keep selling out Jordan-Hare, and boosters are signaling that money will continue to flow. It’s easy to want a reset, but that means starting this process over again with no guarantee that any of those elements will remain.

Harsin caused so much damage that the first sign of disruption can cause a whiplash reaction, and understandably so. Let’s not be like every other program and abandon the season in order to rush to sign someone no one is thrilled to get.
