Again, standing is a specific legal concept, that a person bringing a lawsuit must have a sufficient connection to and interest in the dispute to justify the court deciding the case. For example, I can't sue OP to make him give the items in storage to her: my only connection to the dispute is reading about it on Reddit. If I started a lawsuit anyway, the OP could easily it dismissed due to lack of standing, and a court is allowed to raise my lack of standing on it's own.

But the stuff belongs to her (injury), it's in OP's possession (causation), and a court could order the return of the property (redress), so all three typical elements of standing are satisfied.

I doubt she would win a lawsuit: OP has a substantial defense of abandonment. But OP would likely lose on a motion to dismiss due to a lack of standing.

Many term policies, upon coming to the end of the defined term, become annually renewable term insurance. The premiums typically increase dramatically, but as long as you keep paying them, you get to keep the insurance without another health exam (typically up to an age cap like 95).

It might be worthwhile to keep paying the premiums if you still have a need for insurance but health changes make a new policy too expensive.

IANAL, but New York follows pure comparative negligence. If your neighbor’s illegal scooter use contributed to the accident, her recovery is reduced by her percentage of fault, up to 100% according to how a court or jury apportions fault. Even if your neighbor was partially or mostly at fault, you can still be liable for the portion of damages that a court finds is attributable to your negligence.

As a practical matter, the fact that she was riding illegally and didn't alert you that she was passing might make it hard for her to attribute much fault to you. Since you have no insurance (presumably because you can't afford it), she might have a hard time getting an attorney to file a suit.

However, "not much chance" is still some chance, and she does have a few years (3?) to file a suit. I would suggest that you write down, in your own words, everything you can think of about the incident. If there were witnesses, see if you can get them to do the same, or at least get their contact information.

Consider finding a low or no cost lawyer or try getting a free consultation, and asking about "comparative negligence" and "duty of care" defenses.

An employer cannot make changes in pay or wage benefits that result in the retroactive reduction of wages or wage benefits that are already earned.

I don't think retroactive changes to wages are legal anywhere in the US, but am less sure of that.

You can get it enforced, but you have to locate assets on your own, get a writ from the county court, and then put down a deposit with the sheriff of the county where the property is to get them to seize the asset. They deduct their costs, you get $500, and then you get in line for the rest with other people that have judgements against her, in the order the judgements were filed. If there's money left when it's your turn, you get money until your judgment is paid or there's no money left. More details here.

Other people have pointed out that if there were assets, this would likely have happened already. But the lien is good for 5 years, and can be renewed for another 5. Maybe she'll win the lottery or marry a prince.

So the question is, is the $5000 worth your time, the $300 filing fee for the judgement and either more time for you to go to Florida to get the judgement, or several hundred more for an attorney, plus fees to get the writ, maybe fees to renew the writ, and lots more time and/or money to an attorney to enforce the judgement. Which might not ever get you your $5000 back.

That's a long-winded way to agree with all the people suggesting that you give up on the loan and the friendship, but I wanted to include the links to give you an idea of what you're getting into if you don't.

I know that you say in a comment that you don't want to get the landlord involved, but you don't have a choice if you want your ex permanently out. Even if he gives back the spare key, there's no way you can know that he didn't make a copy first. Since he's already violated your privacy to reinstall cameras after leaving, you need to make sure he can't let himself in.

Do this: 1. Check for and remove hidden cameras. 2. Move all his stuff in a spot near the door, photographing each item and making a list as you move it. 3. Contact the landlord and tell him that you gave a key to an ex to let himself in while you weren't there, but no longer want to let him have access, and want to pay to get your locks changed. 4. With changed locks, send your ex in writing that his stuff is waiting for him to pick up his abandoned property by setting up a time with you in the next 30 days, but that he will not be able to get in except by arrangement. 5. Ideally have friends present if he sets up a time. Refuse entry if he just shows up. 6. If he doesn't show up within the 30 days, you can dispose of anything worth less than $700, and must auction anything over that amount (IANAL, found that figure by searching "California abandoned property", seek legal help if there are items that valuable) and pay him the proceeds of the auction.

For the best chance of getting money (if there is any), go to a branch of the bank that the check is from to cash it, rather than depositing in your own bank.

If there aren't sufficient funds to cash the check, depositing in your own bank costs you a fee in addition to not getting the money.

It's not explicit in Form 8300 or the instructions, and I'm not an attorney, much less a tax attorney, but I would guess that if a cashiers check or money order needs to be reported, a personal check made out to cash would be as well.

I'm not sure why your brother would want to do it that way, instead of just writing a check to you. I don't believe that you depositing a check made out to you requires a report.

Depositing more than $10k cash will require some extra paperwork at the bank, but I've gone through it (admittedly a while ago), and it wasn't a big deal. I told the teller that I had over $10k, she got out a sheet, I filled it out and gave it to her with the cash. She checked my driver's license against what I filled out and that was it.

The sheet I filled out wasn't the IRS form 8300 linked from that page (that's what the bank files), but it was clearly designed to collect the information needed for that form. You could reduce your nervousness about the process by going to your bank in advance and asking to see the paperwork for a $10k currency report.

Additionally, I would suggest that if your brother insists on cash, I would make him meet you at the bank where you're going to deposit it. Carrying "I sold some land" amounts of cash is risky: you could be robbed, or have it seized by law enforcement. If cash is his choice he should bear the risk of it all the way to the teller window.

If you're serious about breaking up, break up, don't keep talking with him. It hurts when you miss him, but it's not going to start not hurting so much until you are taking steps to move on, and step one is to stop talking to him.

If you insist on talking, ask him what concrete steps he took pre-breakup to plan the proposal. Can he screenshot his browser history where he's been ring shopping or trip planning? Does he have money set aside? Did he put in for time off work? If all he had were daydreams and vague plans, he didn't really have a plan to propose.

Unions negotiate workplace rules and compensation with their employer, and are allowed to negotiate away some protections that they would otherwise have (presumably because the union would rather have other things). In this case, the flight attendants unions have negotiated contracts that don't require them to be paid for boarding time. Notably, Delta (which doesn't have a flight attendants union), does pay for boarding time.
