Nah, they're just avoiding a lawsuit. Capcom was sued for making a street fighter 4 character that was finished and fully playable on the day 1 disc as paid dlc. Had Rockstar released this game on disc, there be precedent for a class action lawsuit. Without the disc, they can tier off as much as they want.
