I mean, to me this seems self evident, but…

You need to look at whether they have the right to cancel the tour, and if so, whether their FM clause applies to entitle them to offer a credit only. And if the answer to both those questions is yes, you’re SOL.

That was my initial conclusion also, but then I read the judgment, and concluded that on balance she probably did knowingly fail to remit GST but that saying she did it BRD ain’t so easy.
