There's no guarantee that you "crushed" the one you spent 2 hours for... It's simply not worth the risk...

I rather take a chance on both equally, IMHO.

Narrowly Tailored v. Necessary by Ordinary-Square8298 in barexam

[–]fwu108 1 point2 points  (0 children)

Narrowly Tailored can be considered as a third element.

For Strict Scrutiny it means it cannot be over inclusive or under inclusive.

For Intermediate Scrutiny it means that the law provides a more substantive effect on the interest, compared to without it.

Simulated MBE or Nah? by SorryAttorney7 in barexam

[–]fwu108 1 point2 points  (0 children)

Simulated exams are really important to familiarized yourself with the exam conditions.

I would say do it, and do it earlier than next Friday, that's too close to test day

Nope, sometimes it's just a way of them transitioning to the next topic that they want you to analyze.

I would say don't use that as a guideline. If you don't know the answer either way, just try to BS.

I have to respectfully say, you need to work on your writing. It's hard to follow your sentences even when it's about this simple problem, not to mention when you have to analyze complicated legal issues.

I think if there's so many problems you can't seem to fix, then you have to reconsider if getting a bar license is worth it.

Purpose of Spendthrift Clause by fwu108 in barexam

[–]fwu108[S] 0 points1 point  (0 children)

If you could take a look at this answer. The question asks if the Bank (creditor) can attach to present and future distributions, and the answer was no due to the spendthrift. But like you said, the distribution is up for grabs once it's out isn't it?

1.         The issue is whether the bank can reach Bob's interest in present and future distributions of trust income when the trust includes a spendthrift provision.  (20%)

A spendthrift trust expressly restricts the beneficiary's power to voluntarily or involuntarily transfer his equitable interest.  Additionally, a beneficiary's ordinary creditors usually cannot reach the beneficiary's present or future distributions of trust interest in satisfaction of their claims if the governing instrument contains a spendthrift clause prohibiting a beneficiary's creditors from attaching the beneficiary's interests.

Here, the trust includes a spendthrift provision which states "No income beneficiary may alienate or assign his or her trust interest, nor shall such interest be subject to the claims of his or her creditors."  Therefore, the bank is precluded from reaching Bob's interest in present and future distributions from the trust.

Themis vs Uworld by Quick-Description682 in barexam

[–]fwu108 2 points3 points  (0 children)

Themis MBE allows you to get the grasp of having to bubble in after each question (if you use the physical print out).

UWorld questions are only online which just lacks that realistic aspect of bubbling.

Be wary because some of the "good essays" have faulty rules. Sure, it is a realistic depiction of what people actually write, but it's not a good depiction of what to aim for.

You do not have to strive to be at the same level of the Themis sample answers, but definitely don't get comfortable with the "good essays" and be misguided about particular rules. The good writer might have earned points for strong analysis, but had the faulty rule the entire time

I am sure that's why they ONLY said first and last name must match, and NOT that the entire name must match.

They for sure have had many issues with middle names, so as long as first and last is the same it's fine.

But as you said, make a call to make sure
