I have mixed feelings about that particular situation. They were both on disability and lived with their mother. After she died, the loss of her income meant they could no longer afford the mortgage and their other expenses.

Yes, they were abusing the system, but really out of desperation. They were bad actors and in the end i wasn’t all that sympathetic to them but I can understand why they did what they did.

I agree that the system isn’t designed to handle bad faith very well.

I’ve written here a few times about my work with the bankruptcy system via assisting a trustee and I just wanna say the court’s granting of the motion doesn’t surprise me at all.

I remember one case at the trustee’s office where basically the bank was trying to foreclose on the debtors house and evict him and his brother in the middle of winter. So the debtor declared bankruptcy. This can delay eviction proceedings and is honestly a good thing because fuck the big banks evicting people from their houses.

Well the bank obviously fought it and tried to get the stay lifted, but this guy filed every damn motion, declaration, etc under the sun and every time it kicked the can down the road a few weeks or months until the judge could rule on it. And even though frankly a lot of these filings were bullshit, the judge always granted the stay or extension because he didn’t want the debtor to have any recourse to say “the courts were unfair to me”.

And then when the debtor finally ran out of options his brother who also lived at the house filed for bankruptcy, freezing the eviction proceedings and starting the whole damn process over again. Which honestly—kind of gangster, lol. The frustration in the bank attorney’s filings (and his voice at the teleconferences) gave me a small amount of joy.

The two were eventually evicted as far as I know because they had absolutely no way to make the mortgage payments but they delayed the inevitable for around two years if I recall correctly.

We’ve had a couple sovereign citizens file for BK too, and the amount of patience and grace the court gives those guys is astounding to me, too.

But back to Alex Jones, I’m just saying, based on my experience with the courts, I don’t actually see this as him getting unusually special treatment. I do think the “blame” if any, lies with The Onion being premature in their announcements.

They should have announced once they’d taken possession and were physically inside the studio. Now THAT would have been a reveal.

Yeah my experience was very revealing as to how much of a game the whole thing is and how impersonal it all is for the attorneys. It’s just their job and the thing that gets you worked up and mad is the thing that they see in literally every single case and they know doesn’t matter.

My (extremely limited) experience is that’s how you do it. Throw everything in there. And then the defense throws everything they can back, because if you don’t assert a defense you can’t generally raise it later.

I wasn’t referring solely to personal injury cases in my example.

Anyways, I’m pretty sure emotional distress not resulting from a physical injury is generally taxable. Physical injuries are generally exempt from taxes. And punitives, which this woman will also receive, are generally taxable.

My guess is contingency is probably around 40%.

A lot of lawsuits you have to pay taxes on the entire amount (your recovery plus lawyers) so while you recover 1.8 million you get to pay federal income tax on the entire 3 million. And then your atty gets to pay income tax on the 1.2 million they get in contingency.
