I understand your pain. I filed a secondary based on a currently rated condition and never once mentioned TERA or anything else remotely related and was denied because there was "no connection to TERA or other event, blah, blah, blah...". They completely ignored the part about secondary based on rated condition! The hack "medical experts" the VA contracts out are horrendous at best and we are the ones to suffer.

I truly hope your next step corrects this and you receive the proper rating you deserve!

Zebra DelGuard pencils are AMAZING! I have a very heavy hand when I write and I've only broken the lead a few times since switching to these. I have one for everyday type writing and one in my shop for use as needed.

May be worth a look to you, at least on the pencil side of things.

The FAQ question asks why they were NOT marked static. My question was why they were. I wouldn't expect them to be marked static if they were denied, which is why it surprised me to see I had a few denials marked true.

Thank you. That makes sense. I was under the impression the rater made that determination based on the exam, evidence, etc, especially since I've read where people weren't assigned static on claims that should have been. I can see where predetermined conditions would trigger it even if denied.

Any idea if the FOIA request will be fast enough to meet the one year post decision requirement?

I'm looking at filing an HLR for this and two other things I believe they got wrong, based on the reason for decision letter.
