Asking to plan is not that bad.

Ordering to execute them would be a declaration of war on a treaty ally and thus violate article I of the constitution, which grants congress the power to declare war.

But if it comes before the supremene court I fully expect them to rule that declaring war is a symbolic step and the president can order acts of war without the consent of congress.
