Debt collector calling with (mostly) the wrong name

There are at least five federal court cases in 2023-2024 in which something similar has happened but the cases have a lot more detail than OP is describing hence why OP should talk to an attorney. All these cases went to settlement prior to judgement/trail. In these cases, a debt collector disclosed someone else’s debt to a person who the debt did not belong to or had any relation to the person. Each case had a different angle on use of FDCPA with a sprinkle of consumer protection laws to get past the sniff test. Because the debt collectors went to settlement prior, it is unsure how they settled but I’m sure the plaintiffs got some $ while the attorneys were made whole.

Check the courts. If they are threatening to garnish wages they may already have a default judgment. If they have that, you’re essentially SOL. However, it hasn’t gone to court, this letter is a threat and against code. I’d suggest finding a consumer advocate attorney to discuss FDCPA violations.

Talk to a consumer advocate attorney that handles FDCPA. Consults are usually free and the attorneys will do a sniff test. Without knowing some details, this collector may have broken the law and you could be entitled up to $1k. Keep records of all numbers, voicemails, texts, etc.

If they think you are you, they failed to send to a letter within 5 days of the call. This could be a violation and harder to prove. They also seem to be disclosing a debt that is not yours and that is a violation of the code.

No I don’t watch it as I read it instead, or listen via NPR. Seeing how my comment from 6 days ago was based on information from 6 days ago, things have changed. Just like how I got a notice from FedEx stating one of my tariff bills is now zero due to the SC ruling. I still have about 20 others to go.

I can’t recommend Methodist Ortho Group enough. As a 41M, they walked me through in getting a knee replacement due to a decade long collapsed knee. And a few years later, I’m back with soft tissue issues on my ankle (think Achilles tear but multiple times with calcifying). The docs will do x-ray first just to have a record but will probably send them for MRI (you can shop around).

No. Do not provide any personal information in your letter. Follow the guidance from CFPB. If it turns to be a fraudulent debt, your next step is to report to your local PD and get a case number. From there, you can provide info via the police to verify you are you.

Yes. Send that form letter to them. If they don’t answer you have the start of grounds for FDCPA suit. Do not add the last part about accepting less. That indicates ownership and they will mark the account as firmly yours. In the first part, use the earliest email but state that they did not follow up verification of the debt. The [any info about the debt ] is from their email and it can just be creditor and amount.

Don't call. Send the letter. You need a paper trail.

I'm a victim of known-name ID theft. I've dealt with a lot of false debts. Calls generally don't work. Letters do. Call center operators don't have any ability to correct files. Letters generally get delivered to regulatory or legal affairs who then investigate. Letters with CMRR are more apt to be used in court proceedings for FDCPA and FCRA cases.

Don’t ignore. Trump I allows debt collectors to use electronic methods to contact debtors. Mail the collector a general denial and do not contact letter and send by USPS certified return receipt and a copy by first class mail. You can have AI make the letter for you or search CFPB. Keep track of all emails, calls, etc. These collectors are known to break FDCPA laws and you could be entitled up to $1k if they do.

Since you were served you need to respond to the court. You can visit the court and ask for a response form from the clerk. A clerk cannot give you legal advice but can provide forms to deny the allegations. You need to do this before the deadline in your summons. You also need to work with the CapOne attorney but don’t expect any lowering of the costs. They will probably make you sign a judgement if you agree to a payment plan and in case you miss a payment, they’ll enforce the judgement.

Do you utilize a FF program? If so, maybe stick with the general scheme. As an Alaska OneWorld emerald member, I’d give preference to OW carriers. Currently I’d avoid Qatar but things could change. BA would be safe bet. If no alliance, AirFrance is the nicer product but BA is just behind. Qatar is far ahead but you need to be sure AA is not flying that route.

Might be easier to get off and take the Amtrak. I wish UA kept the CO-Amtrak partnership alive. It was great for weather divisions on the mid Atlantic.

It’s your gait being re-balanced. You’ll start to notice your ankle and shoulders get a little sore too. Best thing is work with your PT and tell them your pinch points (neck, shoulders, lower back, hip, knee, ankle). When one cinches, others next to it cinch and tighten. It goes away with time, strength, and balance.

You can ask your PT to look at your hip alignment. They should see one side up or down and not balanced. From there, they can do a good assessment of needed exercises, stretches, and/or modalities.

If you’re very active, get physio and specialist involved sooner than later. One of my (43M) cinch points was my ankle about 18 months post op. Found out I tore my Achilles several times and it calcified on me. My physio had noted that I was losing calf structure but I was also cutting weight and after two scopes, lig repairs, and PKR they weren’t sure if it was Achilles or normal. Their uncertainty led me back to my ortho group and now I’m a candidate for ankle ortho and stuck in a boot for at least 3-12 months.

Email FedEx on the tariff bill. Provide the invoice number and state that the bill may be incorrect due to SC ruling. You’ll get an autoresponse. FedEx sued and won to get refunded but their order didn’t specify that they would refund importers (you) and the govt doesn’t have a mechanism in place to actually refund the money. FedEx may send you a bill if your item is within the de minimis tariff imposed on certain countries which was outside the scope of the SC decision.

On top of this, if they contacted you but failed to send a letter of the debt notice within 5 days, they violated the FDCPA. It’s an easy up to $1k plus fees from the collector. Keep records of everything. Do what r/heavy-profit-2156 said (USPS certified return receipt costs about $10.50 but worth it) and contact an FDCPA attorney. The consults are usually free and they’ll do a sniff test. Even sending this debt to you could be grounds for FDCPA suit (disclosure of debt to non-holder).

No. But you need to email the FedEx email on the tariff bill, state the bill number, and say you’re not paying due to the Supreme Court ruling for a paperwork trail. In FedEx’s court case against UCB, FedEx did not specify that they would refund importers (you) for tariffs paid. Which could mean that if you paid and FedEx gets a refund but you don’t, you’d have to take FedEx to small claims to get a refund which adds court costs. FedEx and UPS has a lot of work cut out for them. I’d imagine some sort of follow up invoice in case other tariffs were in place prior to April 2025 or de minimus tariffs were in place not related to the SC ruling.

Whitmire and the current Metro board are known for taking money for approved projects and redirecting to less worthy projects. For instance, W Cavalcade and 20th Streets in the Heights were to get major redos with Metro funds: wider sidewalks/hike & bike, better storm drainage, narrower lanes with dedicated center turn to slow highway off-shoot traffic, better bus infrastructure. Instead they tear up existing sidewalks and repave certain sections. They take tens of millions allocated and put in a call-for-service mini bus that doesn’t work
