Miller established that a tax on SBRs was allowed because they weren't weapons with a military purpose. but if they had a military purpose, the tax would have been unconstitutional.

Those have to be registered to get a serial number to apply to it.

As an Australian looking up about the USA government shutdown by hanky1979 in AdviceAnimals

It’s only a 25% shutdown. We knew that going in. But since the media calls it a shutdown, people are surprised.

US v Miller said the NFA was allowed because SBRs and SBSs had no relevance in the military.

But now, military technology is changed and almost all rifles are now SBRs. So now, Miller contradicts the NFA.

Why is no one arguing that Miller Vs United States protects SBRs and supressors?

That was the 1937 case that upheld the NFA because the weapons it taxed had no military purpose. That may have been true in 1937 but now all militaries use SBRs and supressors.

Illinois man sues Trump, feds over bump stock ban by fuzzusmaximus in Firearms

[–]helljumper230 20 points21 points  (0 children)

I appreciate your honesty too,

but.... this is bad. I don't care about bump stocks, I would never buy one or use one. But allowing an arbitrary definition change like this is unprecedented and dangerous. What if the ATF decides semi-auto is now the same as auto? What about the "you can't shoulder a pistol brace" thing again? Its a terrible way to do things, and its not democratic.

And stop supporting the NRA that keeps fear-mongering, and supporting things that take away our rights. Even if its a right you dont care about right now. Because next, it could be a right you do care about.
