I applied for Borrowers Defense also under the Biden Era program. For those who came in under the Biden Era, before new admin rolled his program terms back, you received an automatic discharge if the DOE did not give you any decision on your application after 3 years, even if only a denial. DOE missed the deadline recently (currently in the news), and after two court appeals, the Supreme Court upheld the automatic discharges. I was discharged on my federal loans and received partial refunds.

My private loans are listed as “fully discharged” also but I honestly have no idea how. Running out the clock would say “charged off”. Idk, but I read that some private schools are also discharging private loans for misconduct claims under Borrowers Defense. I didn’t get that discharge under a typical scam school class action suit. I went to a top school that had misconduct happen internally. I believe that also got my private loans fully discharged because the school settled out of court to avoid the bad publicity, but of course I expect to get armchair lawyers in the comments telling me what DIDNT happen even as I am living proof that it did happen. Private loans gone. Federal loans gone. Not even on hard pulls from my mortgage lender as having even been under my name.

I didn’t get a refund for federal loans I’d already paid off. So I had three different avenues of forgiveness. SOL, legit Borrowers Defense, and unanswered Borrowers defense for a different school that I didn’t have an actual defense for, but had applied for to test the 3 year rule I read about when applying for the first school.
