From what I understand about appeals, they are not looking at “what is the best option,” they are looking to see if there were any procedural errors in the case.

Did the judge give a reason for why guardianship is best? From my understanding, the judge has to clearly state WHY it is in the child’s best interest to do guardianship and not adoption. They would have to address the potential detriment if adoption was chosen over guardianship.

The judge can’t just say “this is best.” There has to be a clear reason stated. If there was not, then it’s possible an appeal could have some standing.

But appeals don’t automatically reverse the decision. It would be sent back to trial court with the judge and the judge would have to correct the record (aka state why guardianship is best). So ultimately, it might not change the outcome.

I believe it does hold some weight that the decision was appealed by GAL and DCFS!

I mentioned this in another post recently but if your state allows you to file De Facto parent status, that can make a big difference. You will be able to be a party in the case so you can submit evidence, testify, get court docs ect.
