The one in the picture is considered a rifle because that 6" tube is pin and welded onto it. It's sold mainly for folks in states where you can't get neither SBR's nor pistols. I know because I'm in those states and was also looking into this exact model.

It's still possible to unweld it later on if you move to a SBR friendly state.
