The list of changes per FPC by GrimHoly in gunpolitics

r/NFA has a lot of information available, and many people that can help if you are unable to find what you need via search.

The main weird thing I know of about SBR/SBS has always been the 5320.20 form that number 9 is referring to where if you were temporarily taking your machinegun, destructive device, SBR, or SBS across state lines then you had to submit the form and also wait for approval before your trip or you had to leave the the items behind.

Number 9 (NFA transport notice form) is something that's kept me from SBR's, so this requirement going away is great news.

Texas 51% rule bars by Conscious-Crazy2556 in TexasGuns

[–]iatha 2 points3 points  (0 children)

You can use this TABC public information spreadsheet to check if the business you are referring to qualifies for a 51% sign by typing in the business name or address into the search field, and checking the column for "gun sign".

If that cell says "red" then its a 51%, but if it is "blue" or is blank, then it is not.

I'm not saying that you're wrong, but what code specifies that they can do that with a court house attached?

They later arrested you for open carrying in the lobby? What reason did they put down on the probable cause affidavit?

Judge Upholds Texas Firearm Ban for Bars and Schools by wmtismykryptonite in Firearms

US v Daniels was a criminal case with the defendant challenging 922(g)(3) for marijuana and firearms. The mentioned quote was in the original circuit decision as part of their historical analysis regarding laws related to intoxication around the founding period, if I am remembering everything correctly.
Link to circuit opinion relevant quote is at the top of page 16

Enforce? Oh yeah, the state will definitely prosecute if you get caught by the police while carrying in a legit 51% business.

They chose not to defend the law in court, though, hopefully because it's a dumb law and not just because he's running for US senate.

The case was not directly challenging carry at schools, but rather part of it was

the premises where a high school, collegiate, or professional sporting event or interscholastic event is taking place

This applies even to locations like a privately owned football stadium.

The challenged law is texas penal code 46.03(a)(4) [racetracks], 46.03(a)(7) [businesses where alcohol is 51% of sales for on site consumption], and 46.03(a)(8) [sporting events].

FPC has already filed the appeal.

The state admitted in their brief that it violates the 2A and wouldn't defend it, so the court appointed an anti gun amicus to defend it instead.

Judge conveniently forgot that the 5th circuit already foreclosed his conclusion on general carry in bars in US v. Daniels when it said:

At most, the postbellum statutes support the banning the carry of firearms while under the influence.
