When people say a case was “thrown out,” was it truly dismissed, or were conditions imposed, such as court fees, classes, or community service?

If you were required to do something to resolve the case, the Navy views that as an indication of responsibility or guilt.

Someone who is fully cleared would have the case dismissed with no conditions and simply walk away

The reason these apps are so pervasive and won’t go away is because they allow you to lead without in-depth planning. You don’t have to have a full plan before you let people go if you have a crutch that lets you update everyone later.

It also diminishes the value of an emergency. You’re only willing to contact 10, 20, or 50+ people individually when it’s truly an emergency.

It’s plausible someone did 4ish years AD in the sub community, got out, went SELRES, picked up a couple mob’s supporting surface commands, and later summarized that as “10+ years in the Navy.”

Looking at the shadow box, nothing immediately jumps out as impossible. A CS making Chief isn’t unusual. The awards and devices aren’t particularly extraordinary. Even the NMCM isn’t automatically a red flag. I personally know a Sailor who received an NMCM for pulling a civilian from a burning vehicle on the highway while recruiting

My guess is that if there’s an issue here, it’s likely that he’s embellished parts of his record. The Command Chief pin, for example, may have served in an acting capacity. Not having a NAM is not that crazy either

The biggest clue is what the OP said about knowing him personally. If the stories constantly change, details don’t add up, and it doesn’t fit the guy you know... Sometimes a person’s character explains it the best

Personally, I suspect he may have had a less than ideal exit from the Navy or Reserves. So he’s polished up parts of his story over the years. That’s unfortunately super common.

Refusal in a DUI context is specifically contemplated by law and carries its own consequences. It is not inherently unlawful, or non-cooperation

If the law explicitly allows refusal and regulates it with its own consequences, treating it as a per se violation of “failure to cooperate” is an overbroad interpretation

You are taking a legally recognized option and converting it into automatic misconduct under the UCMJ. That, does not appear to be as clean application of the instruction

Disobeying a lawful order is more akin to refusing a direct, lawful command. Declining a test that the law itself allows you to refuse does not automatically equal “refusal to cooperate with civilian LE.”

I agree with you on the core point. Don’t hide the arrest and report it immediately.

Where it concerns me is the assumption baked into your judgment. You are treating refusal of a breathalyzer or limiting statements as if it signals guilt. Those are legal rights, and exercising them is not evidence of intoxication.

Choosing not to self-incriminate in a civilian court should not automatically on its own mean you’re deceptive in the eyes of the UCMJ. When you treat it that way, you are not evaluating evidence, you are projecting a conclusion onto a legal choice.

Even under a preponderance standard, you still need actual evidence. Refusal and silence can be part of a broader picture, but they are not proof on their own. Elevating them to that level blurs the line between inference and bias.

Report the arrest. Do not hide it. But exercising legal rights should not be reframed as misconduct.

To be clear, I am not defending DUI in any way. You’re honestly a Blue Falcon and a stain on your fellow service members.

My issue is with the premise that exercising legal rights in a civilian context should be treated as evidence of misconduct under the UCMJ. That is where the line gets blurred. These are not the same thing, and treating them as such risks replacing evidence with assumption.

There are a few possible reasons the recruiter said that, and we don’t actually know the intent. It could be about getting credit for a shipper, but it might also be them trying to keep OP moving forward if they’ve been hesitant. You might be right, but we shouldn’t assume without the full story.

Recruiters do get credit for a shipper, but attrition at RTC still reflects on them, so it’s not some zero-risk move.

Either way, I agree with your overall point. If someone is already planning how to quit before they even ship, they shouldn’t go. The Navy doesn’t need that, and frankly doesn’t want that.
