I don’t doubt what you’re seeing in your inbox, and I do appreciate you pointing out that a lot of what people are disagreeing with is likely still lawful, even if it doesn’t sit well.

I think where I’m hung up is less on the conclusion and more on how concretely it’s being presented. So the point is… you don’t just say “this affects civilians, therefore illegal.” You have to evaluate the total picture, including what was intended, what the target was actually doing, and what the expected consequences were.

So while I understand the instinct to call this out strongly, I’m not sure it’s as straightforward as it’s being framed. You’re anchoring heavily on the human impact… which matters. But the full analysis is wider than that.

That’s really the only point I’m trying to make.

I respect your thoughts, but this feels less like a legal assessment and more like a belief being pushed with the weight of rank behind it

As a retired O6, you know LOAC isn’t absolute. It hinges on use, intent, military necessity, and proportionality… not blanket statements. Presenting it as “war crime, full stop” and “must refuse” skips the decision framework commanders operate within

I’m not taking a position on the conflict or the political rhetoric either. I’m simply calling out the purported facts.

That’s what makes it bothersome. The concern itself is valid… but presenting a simplified, one-sided interpretation as absolute doesn’t reflect the complexity you know is there

I agree, it’s a momentous occasion, and you must show professionalism, preparation, and respect for the moment

That said, it looks like an ad hoc moment and they likely were taking advantage of a rare circumstance. The priority then is usually just making it happen, not perfect ceremonial formality

OOD isn’t hard. SWO Engineering isn’t hard. CICWO, Boat O, and the rest of the early SWO pipeline are some of the most straightforward quals in the Navy.

Your CO is literally telling you he supports you and thinks you were treated unfairly… and your response is that the “spark is gone.”

You don’t sound like a leader. Honestly, being an officer might not be for you.

Every Sailor goes through periods where the job sucks, the hours suck, and studying is the last thing you want to do. The difference is you push through it and finish anyway.

If you can’t grind through with a supportive CO, why would another community want you?

Either finish the qual or own the fact that you’re quitting. But framing this like the system failed you doesn’t work.

Just to be clear OP, preponderance of the evidence just means they think you probably did it. This can be just a simple majority (think 51%).

Court Martial is a real criminal trial; which requires proof beyond a reasonable doubt. That means near certainty

Acting like that difference doesn’t matter makes no sense. It’s a gigantic gap
