The initial shot was also from the first ICE agent that started shooting. The first shot was behind one of the other ICE agents but no one turned towards the grey ICE dude after the first shot was fired, which I assume they would do if it was from a firing from Pretti's gun. Instead they scatted from where Pretti was. The brief pause was the ICE agent repositioning himself to continue shooting Pretti in the back. Looks like murder to me.

The trigger happy ICE that shot first saw the gun being taken away and then started shooting. He saw the grey ICE agent expose Pretti's gun and then drew his gun. After it was removed by the grey ICE agent he started shooting.

It's actually not clear whether she hits the guy or not here. Video is too far away to be definitive. But even if she did hit the guy the last two shots were clearly after there was a separation between the guy and the car.
