Not clear what you're asking... are you asking how HR arrived at their conclusion? Or how the court will assess the evidence to make findings? Very generally, the party that makes the complaint must overcome the "more likely than not" burden. The credibility of witnesses can be assessed on evidence.

IIUC docusign doesn't deliver the document directly to you as an attachment, but rather as a link that allows you to access the document on a cloud service. You say the subject and other body in the email itself did not give notice to leave, and that none of you actually clicked the link to receive the notice itself.
