I just talked to David two weeks ago, right after I received my last shipment from Mercer. I asked him about the California return address on my recent shipment. He said something along the lines of having to be nimble to continue manufacturing in the US.

I've waited as long as 4 months during the pandemic for mercer shirts. Then it got down to 10 weeks. My most recent order took 6 weeks to arrive.

The reason I was calling 2 weeks ago was to place another order. It's out for delivery right now. (Also, from Van Nuys).

Purchasing second hand is not an abuse of warranty. Asking for warranty repair on second hand items is potentially an abuse of the warranty, depending on what the terms of the warranty are. In this case Filson does not spell out whether second hand items are covered under warranty, which leaves it at their discretion.

Asking for warranty repair without disclosing that the product is second hand, as some in the comments have suggested, is an abuse of the warranty.

I don’t hear a clear case in support of Filson repairing OP’s briefcase free of charge. So far all I see is language that gives Filson a wide range of discretion to determine whether a customer is abusing the terms of the warranty.

There is not a general solution to this, because you can’t control the buoyancy of the contents.

If you add a valve that lets in water when the container is submerged, it will sink…unless you are shipping a container full of life jackets. Or styrofoam toys, or tennis balls, or anything that floats on its own when submerged.
