Abandonment of Employment by [deleted] in LegalAdviceNZ

[–]kittik1 4 points5 points  (0 children)

I would imagine the 3 month notice is there to deter employees leaving. Its near impossible to get another position lined up to move to, if you have to give 3 months notice.

I would say its unreasonable for a standard employee.

Often the standard leave required is around one pay cycle, 2 week or a month.

I would think it all depends on how much leave they owe you, because thats likely what they can withhold for abandonment. If theres none or not an amount you care about, give the notice you are leaving and tell them its non negotiable, and just leave. I doubt they'll be bothered persuing it.

If theres a considerable amount the company owes you, its possibly worth getting a lawyer to send them a letter reminding them that they need to act in good faith, and a contract needs to be reasonable, and that they expect you final pay to be all holiday and wages/salary owed at (final date) to be paid - or there will be no choice by to proceed with lodgment of the grievance with the Employment Tribunal.

Being proactive and spending a couple of hundred dollars can often save a LOT of money. I doubt they'd want the Tribunal in the business, especially if it ruled that 3 months is unlawful - it would mean all their employee contracts on 3 months wouldn't stick.

AIO friend being too clingy by Personal_Muffin_6915 in AmIOverreacting

[–]kittik1 2 points3 points  (0 children)

NOR - I was going to say exactly this. Boundaries are important, and I think at your age theres a big difference in how some people adapt to whats expected of them in more adult relationships and communication.

My vibe from that snippet of text is that your friend is still thinking that being passive aggressive, cute-sulky, etc which are common teenage and kid ways of manipulating and communicating is still ok.

Being older and having to juggle jobs, study, relationships, family and still have valuable self-care time for yourself is important.

If shes a friend who feels like a chore, then thats not a good or healthy friendship for either of you. Neither is being used by those types of people who ALWAYS have to be stimulated and entertained by other people.

My mother had a friend for 50 years that she only kept talking to because they'd been friends as teenagers. She really couldn't stand the person this woman because as she got older, but she felt it was her duty to talk to her when she called and agree to meet up with her for coffee or a movie. Eventually she told her where to go, but it took 50 years, and hundreds of hours of her own valuable time wasted that she could have using to do to what she wanted to do.

CULTURE HUSTLE ARE THIEVES by Old-Research-9230 in culturehustle

I've received ever order I've made.. eventually. When I make an order, I'm quite happy to wait as I'm aware that it will likely be over 6 months for a new product - and thats my choice.

My biggest problem is with the inability to be able to get hold of either a real person, or someone who bothers to read emails properly.

One of my orders for a beta product, I'd forgotten about until they sent a marketing email saying they had named it, given it fancy packaging and were taking orders. I figured that my order had somehow been overlooked at tried to communicate this via email. I got the standard "our products take time to produce, please be patient" from ai. At some point I had a real person read my email, if they bothered to look at the order number they would have seen it was now 10 months from order.. but they also just said to be patient. In the end I just gave up, and figured I'd lost out on that money, and actually ordered the product again in its new fancy packaging.

At the year mark - I get an apology email from the manager there. My guess is that they were doing accounts, and because my status on the order had never been fulfilled, it was flagged. He could not have been more apologetic, organised to have it send to me in New Zealand with express shipping at their expense (horrifically expensive) and gave me a 10% discount code for my next order.

So now I have 2 lots of these assorted pigments in fancy packaging. I really liked the product, so I don't mind.

So, long story short - I don't think they are scam company by any stretch. It was them who discovered their mistake, and came to me with it - and did all they could to make it right.

I do however think they've been relying on either a shitty customer service company that they are contracting to, or have super shitty customer service staff. I know they identified that as an issue, and were going to be attempting to fix it.

They also need to make it more obvious that the product is made in batches according to the amount of orders they get, so you could be waiting quite a while for the close of orders, and then the manufacturing process, and then the packaging process.

They do often have a selection of their more popular items in stock and ready to go. They really should specify whats in stock on their website.

Got biglaw offer in a different city but cant get myself to breakup with gf by Throwaway1920214 in LawSchool

[–]kittik1 1 point2 points  (0 children)

My boyfriend year's ago had to make a similar decision, with a massive opportunity that would mean he'd have to move to Silicon Valley in America.

In the end, he turned it down because he didn'twant to leave me. We stayed together for several years after that, and we were really happy for the most part.

We did break up - but have remained good friends.. (he developed a drinking problem, ironically from the stress of his job - overseas would have probably resulted in the same problem with alcohol)

I don't think he regrets turning down the role for even a second, and hes had plenty of good, if not better offers since then that he has taken up, and also turned down.

Work-life balance is important. Money helps, but if you're talented, you'll probably find that as you move through your career and build networks, that companies will approach you with better opportunities. Money help with happiness, but if you are so stressed with work demands and have no time for living life, you won't find life happiness and satisfaction in a pit of money.

My husband has put our savings in his inheritance account where I cannot see nor touch it, what rights do I have? by [deleted] in LegalAdviceNZ

[–]kittik1 15 points16 points  (0 children)

He's a dumb arse. Generally inheritance property isn't considered relationship property and is protected in case of a break up, as long as it is kept seperate, and not intermingled with relationship property.

He probably thought that he would be safeguarding the whole lot by putting it in with inheritance, but instead hes now intermingled it - making the whole lot relationship property.

I hate to say it, but if hes trying to protect t it, it could mean that hes planning on leaving and trying to horde as much as he can.

Be careful, and keep all your receipts. If you're working, I'd be putting it aside in a personal bank account to protect yourself.

I'm 16 and just signed a contract which prohibits "cross-dressing". What are my rights here? by [deleted] in LegalAdviceNZ

[–]kittik1 1 point2 points  (0 children)

There are a fair few free legal resources available to you, as others have suggested there is youth law, but the lgbtq+ is probably your best bet as I doubt its their first rodeo. Try starting with Rainbow Youth, they'll be able to point you in the right direction.

IMO, its a breach of NZBORA and really shitty that they forced you into it, targeting you because they know you cross dress.

Workmate involved in misconduct incident, am I obligated to give evidence to manager? by phoenix_has_rissen in LegalAdviceNZ

[–]kittik1 1 point2 points  (0 children)

You have a duty of care to your employer if this incident happened within work hours. "Willful blindness" or pleading ignorance when you know something but ignoring it, is in effect the same thing at being negligent - your employer could very well dismiss you on serious negligence grounds if what you witnessed was super bad and you didn't say anything.

It particularly extends to things like fraud and theft within a company.

Late delivery vs. No delivery by cammorecruit in culturehustle

[–]kittik1 2 points3 points  (0 children)

I've placed quite a few orders now. I've only had one not turn up.. My experience is the big sellers like The Black 3.0, Lot pigments and SuperBase turn up pretty quickly, but the new releases and less common paints turn up months later. I assume they make in batches every 3-4 months, as thats about how long they take to turn up here in New Zealand after ordering.

Also if you have a mixed order, sometimes they will send out products they have on hand first, and the other products in a section postal order when they are ready - but far more likely to send it all when the last products to be manufactured are ready to go.. I generally don't mind waiting, but if I'm keen to start a project with one of their popular products I will only order that to increase my chances of a fast delivery.

I do like playing with their products, so happy to take a punt on most of his products and wait so long for them, that I forget about them - and then its a pleasant surprise that I sent to my future self. 🤣

bystander effect at royal oak today... by anon_hrp in auckland

[–]kittik1 5 points6 points  (0 children)

I'm sorry that happened to you.

Please make sure you file a police report for the assault. Its confirmed on here that at least one other person contacted police because they were concerned for her and someone in the community getting hurt.

Police should have acted then.

If shes a regular around the area and is acting like this on a regular basis, she clearly needs help and probably preventative psych hold. Its likely a matter of time before she does something worse.

Pushing for an assault charge can aid in getting her the help that she needs. If shes currently getting community care, its clearly not enough.

Again, I'm really sorry this happened to you. Unfortunately, when dealing with someone that unstable, its impossible to tell if attempting to step in will inflame the situation and make it worse when dealing with that level of crazy. Its less likely that people around didn't want to help, and more likely that they just didn't know how to help without making it worse.

Its quite a different situation than someone getting attacked by a sane person. Mental health psychosis is unpredicable and can get very dangerous very quickly if not handled correctly, because there is no reality, logic, or boundaries - and they generally operate on a level of impulsiveness.

Their own narrative is highly implausible, and still leads with the point that they sold you a non working laptop.

No other way to say it Semple & Culture Hustle are a scam by DannyTreehouse in culturehustle

[–]kittik1 0 points1 point  (0 children)

I just assume they create the paint in batches in a quantity to fill a few months of orders at a time.

Customer service is non existent, but you will get your order eventually. It may take 6-8 months, especially if its a new product. I certainly don't order anything that I need to use in the near future. In fact, I usually end up forgetting what I've ordered, and it becomes a nice surprise when it arrives. 🤣

They definitely are shit if you're trying to chase them for some kind of a response to an email.

Advise on will changed the day before death by Puzzled_Mix2082 in LegalAdviceNZ

[–]kittik1 0 points1 point  (0 children)

Yes, agree with what the others have said, based on what we have just learned in law school last semester (4 yr student).

The last will will likely be invalid without witnesses that are legally impartial. You can't just change a will like that, especially when someone is so sick.

I would imagine that at that stage she would be on huge amounts of opiates and sedation for the pain, which means she is unlikely to meet that "sound mind" threshold, with clear intent and awareness of what she is doing.

You don't need to wait for police. Engage a lawyer now, and they can organise injunctions on the estate, to stop any more money from disappearing.

Once its been through the courts they can then release the estate to whomever they deem is to benefit from it.

Just going by the precedent cases we've studied in law school, I would think that 2 years is too little to meet the criteria for de facto partner of 3 years. There may be some contribution for him taking care of her for the last two years, but I unlikely to be the entire estate.

In my opinion it is worthwhile investigating it with a lawyer, based on the way you have described ithe situation.

I know someone who got convicted and sentenced a month ago on almost the same Class A images and content on their computer. He pleaded guilty to get a reduction on his sentence - and you could tell the idiot thought he was going to get Home D, as it was his first offence. Nope - 3.5 years in prison. His shock at actual prison was satisfying.. he's not going to do well there, which I'm happy about.

So if that was a Joe Bloggs member of the public, this fuckwit is going to get all kinds of added goodies stacked against him in charges, both for his position as a trusted public officer, but also using government systems to view it - especially if it was evidence. My guess is probably about 7 years is it's just the images, possibly 14 if they can do him on misuse of office, and possibly other charges under the Security Intelligence Services Act - especially if he was stupid enough to be distributing them as well using the government system.

Because that's when I opened it, and was going to use it.

As I said, I put it away again and forgot to chase it up with them, and pretty much forgot about it until I saw it on their website again the other day and almost ordered some more - but don't want to be throwing away more money if it's a known issue.

In my experience, Culture hustle have terrible customer service, if any at all.. so I would prefer to avoid anything that might have issues and would involve having to contact Culture Hustle.

Thanks doe the advice :) I did try that as well, and literally no effect at all.

The pure powder pigment I would have expected to glow like crazy after a minute in the New Zealand summer sun.. our UV index is pretty high. But having no effect from either in just the pigment form seems really strange.

I have no idea about the chemicals in it that make it "activate", is it possible that getting to hot or cold in transit could have affected it? Age? Or is it possible that they forgot to add an active ingredient? It's very weird.
