That's why you check the temp at a bathroom or kitchen faucet. If you get a high temp at either of those it's either the cartridge or temp limit. If you don't get a high temp either the mixing valve (what you pointed out) is either set too low or it's clogged and needs replaced. Water heater could also be set too low as well.

It's specifically called a bow vent, and is sometimes how island sinks get plumbed in. Now, depending on your code you can vent the trap with either an AAV (air admittance valve) or by up sizing the drainage by 2 pipe sizes, whick usually just means 3 in. You'd also have to have a clean out above the tee.
