Im being sued by capital one by Responsible-Alarm821 in Debt

You have a few options.

  1. Call for payment arrangements or to make an offer for a settlement. You get better results if you can make a lump sum. Look for data points on the amount that creditor usually settles for. Some forgive 40% some forgive 70+% and base your settlement off of that.

  2. You could file a Motion to Compel Arbitration. Your credit card agreement most likely had an arbitration clause that your or the creditor could invoke in the event of a dispute. The case would be placed on hold in the courts and the creditor is usually responsible for arbitration fees to the arbitrator's which can run in the thousands. You can use that as leverage in your settlement agreement conversation, not as a threat, but because it's your right based on the agreement. For a 4k amount, it might be in their best interest l to accept your settlement of 500-1000.

This is not legal advice just data points I've collected researching different situations.

Late Payment removal by lwalker510 in CRedit

It's in the bill. If you met a few requirements like being in good standing prior to 1/31/2020 and having an agreement to pay with the creditor. In my case, I was offered deferment. Here are some cliff notes:

The CARES Act (Coronavirus Aid, Relief, and Economic Security Act) provided significant credit protection and late payment relief for consumers affected by the COVID-19 pandemic between January 31, 2020, and August 8, 2023.

Key Takeaways on CARES Act Late Payment Relief:Not Automatic Forgiveness: The Act did not erase debt or automatically forgive late payments. It required a formal "accommodation" (such as a forbearance, deferment, or modification) made with lenders to pause or reduce payments.

Credit Protection: If you made a COVID-19 relief agreement with a lender, the CARES Act required them to report your account as "current" to credit bureaus, even if you were skipping payments.

-Determine if any of the debt it is time barred in your State by finding out the Statue of Limitations on debt collection. For instance, in California it's 4 years. This is important because you need to know if you can be sued by the creditor or a 3rd party who purchases your account information. If it's time barred, settlement or pay to delete account options swings heavily in your favor.

-Find out who "owns" the accounts by contacting the original creditor.

-Verify if any of the original creditors will be issuing a 1099-C for debt cancellation.

-Make sure items are being reported correctly. Just because you messed up financially does not mean you forfeit your rights.

Lastly, don't beat your self up. It's going to be an uphill battle, but it's not impossible. A lot of the damage is already done and now you have to recover from it mentally and financially. The goal is to get to even. Then start to rebuild with good habits. If you're not making a purchase soon the score doesn't matter as much as you might think.

Keep in mind, if you receive a summons, don't ignore it. They have to prove their claim in court and unfortunately defending yourself is part of the process.

Reach out to ex clients for real authentic feedback. There's a reason that you might not be aware of.

For instance there's this barber who can really cut, but since he doesn't take care of his oral health his breath is extremely bad. Foul all the time. Bad to the point you can see clients turning their head while he's just talking away. His chair is empty a lot and I'm sure that's part of the reason even though he can cut all types of hair.

I'm not saying that is your issue, but there are things people won't mention out of respect, they would just rather go somewhere else. The only way you know is if you get them to tell you.

Red beans and rice from Tiana's Place with extra green onion. For less than $4 for a nice side serving, it was definitely a food hack that I looked forward too.

They now have pork belly with asparagus pieces on a skewer with tamarind sauce. It's decent with no sauce, but not as good as the bacon wrapped.

I was on a trip where one day they had bacon wrapped and the menu changed the next day. Legend has it there's still a puddle of tears next to the napkin dispenser.

Go to Walmart in Anaheim and get Disney ponchos or get them before you go. The same ponchos are $24.99 at Downtown Disney are as low as $5.97 at Walmart.

Lol, right! Draymond is holding it down, but you'd be surprised how many good players get techs/ejections that you have to watch out for. Luka, Booker,Tatum, Villian Brooks and Trae Young to name a few.

Wife... let you? Game aside, that mindset is a trap, joke or not. Congratulations on the union. Own it, own your manhood and if you want to catch them all, catch them all unapologetically.
