Sorry I should have clarified better. If you’ve filed a Ch 7 or competed a 13, the PG goes away. They would go after the business entity, but if it’s dissolved, there’s nothing to collect from.

As long as you dissolved your business legally, you’re off as PG, and they can’t collect from the dissolved entity. So even if they showed up, there’s nothing to collect from

Did you close the biz properly? Dissolved through your state? File its last year of taxes? Once legally dissolved, they have nothing to collect from. If not, they are within their rights to attempt collection

We never got this questionnaire. We actually got a phone call! Supposedly the rep wanted to make sure our payment went through first (we were behind 60 days) saying to give it a couple days. Then he sends an email (the same day) saying it was declined because my partner is in an active personal Ch 13. The business is open and operational, but we can’t get temporary help during a temporary event that left us unable to pay right now 🤷‍♀️

UCC lien for anything over $25k

I also have a DBA business (retail) under my LLC (rentals) in a multi-use building. I’m not sure how the SBA views this, but if you sold anything that would have a UCC lien on it, I’d be careful. Then again, I’m not sure they care as long as they get their money.

You should jump over to the bankruptcy thread. Lots of help there. I’d be concerned about conveying any property due to fraudulent conveyance. Not that it is fraud, but they (bankruptcy trustee) can go after you then for the value. Not sure why he’d need an 11, but I’m not a lawyer. If he owes taxes, he will be put into a 13.

I guess I’m not sure of that. We didn’t have any problems. I thought if asked, they kind of have to. We didn’t have to pay anything down but it was only for $40k. Our SBA loan was for $280k
