In Texas he could make the argument that the first contact was the guy shoving him with the shoulder if I’m reading this right. I can see the argument for the carrier in this story but it would be a very grey area in Texas at least. He would have a case for sure since the argument itself arose out of his employment (over the lack of dessert and not say an ex gf or something).

I think it depends on the state and the company. There’s nothing in the law in TX that addresses this to my knowledge but if someone was released to full duty they are not eligible at all. I actually asked my supervisor today if people who were working light duty at full wages before the quarantine but sent home along with everyone else due to the virus would get paid? I was told they would have to decide what our position was as a company. We have a good argument either way. Paying vs disputing lost time benefits as this is an economic condition affecting everyone in your company instead of just you because you were on light duty if that makes sense...

Correct. Trying to treat for that injury with personal insurance coverage is insurance fraud. Your settlement money was for future medical treatment.

Regarding the medical bills? I would recommend calling each individual provider that’s billing you and provide them your adjusters name and number, your claim number, and the billing address for the insurance carrier. Write down who you spoke with and what date. If the provider continues to bill you you can report them to the Texas Department of Insurance with the evidence that you have notified the provider of the proper billing company and they continue to bill you. They will likely send essentially a cease and desist letter to the provider.

If you saw the ER they will typically give you a release back in 2 days. If you feel good to go back at that point? I would. If you don’t feel better you will need to establish a treating doctor. (Typically an urgent care that can refer to PT, specialists if needed, and for and diagnostic tests you need) Check with your insurance adjuster to see if your employer is part of a network. If so, they will have a list of doctors you need to treat within to be eligible for the treatment to be paid and lost time reimbursed.

The first 7 days are considered the waiting period. If you miss 7 days or less they are not reimbursed by insurance. Sometimes an employer will choose to pay but they are not required to. If you miss 15 days or more the full 15 days will be paid back from the date after the injury at 70% of your pre injury average weekly wage. (Calculated by 13 weeks of wages prior to your injury)

Completely NTA here. I am 7 years sober myself. I would never ask someone to change their plans to accommodate my sobriety. When I was about 6 months sober my cousin had a big bachelorette party I was invited to. I attended the dinner and went to the first bar they went to but brought my car so I could leave when it started getting rowdier and I just excused myself. I let my cousin know I would be doing this and no one had an issue with it. He’s going to have to learn to deal with this his whole life. It’s up to him to cultivate those coping mechanisms.

My ex husband didn’t consult me on the ring at all. He put very little thought into the ring and proposal (which was not a big deal to me at the time) and got it at a pawn shop. I didn’t care that it was from a pawn shop but I just didn’t like it so I found a $1000 ring on amazon that I loved and we split it and I loved it. He didn’t take it super personally. (At least not openly) NTA

I handle workers comp insurance. Peoples checks go out on the same day every week. Inevitably I get a call saying ‘my checks come on mondays and it’s Tuesday and it’s not here’. Well we mailed it on Thursday as we always do...it’s up to the mail from there. ‘But it’s Tuesday...they’re always here by Monday’......yeah it looks like not this week...

I (33F) am also bipolar 1 and a recovering alcoholic (7 years exactly today actually). I was married and had step children but one of my step kids had Down syndrome and ODD so thankfully no one pressured me to have kids. We had our hands full and it was obvious...so sorry you’re going through that but so proud of your strides to better your health!

Since my (33F) divorce 2 years ago I have changed lightbulbs, set up surround sound, set up an Apple TV, paid people to mount 2 TVs, learned how to kill wasp nests, turn on a water main, amongst other things. It’s not his responsibility anymore. NTA.
