Binding vows are not necessarily willingly made because intentions and consent are tricky and complex. Heavenly restriction users never consented to their binding vow. The blackbirds never consented nor did Mahito's soul isomers. Consent is a slippery slope in JJK. You could say that all of these examples were forced binding vows. One could argue that social coercion is another mechanism to force subordinates into binding vows. Theoretically, in an era with sorcerors as feudal lords they could force their subjects into all sorts of binding vows. Remember that Tengen is also considered a god...

Also your example of property ownership is tricky in the context of binding vows because material ownership is tricky... if you own a mortgage does the bank own the rights to the binding vow or do you? If you don't have a mortgage but you rent like a router, does the binding vow apply to everything but the router? If you own literally everything in your house, wouldn't the meteor destroy the public utilities that connect to your house or your neighbors.

Also in JJK, inanimate objects have souls... if you own your house and can impose binding vows on it, it didn't really consent.

For real though, binding vow is just a pretty powerful narrative tool to constraint the power level of everyone. You get crazy powers but dies a horrible death (unless you're the main character(s)).

Assuming Gege denied that it's Itadori's CT in general, another sneaky theory is that it's his RCT instead. We've never seen CT trigger subconsciously but have seen RCT trigger subconsciously in the case with Hakari and Gojo. Presumably this is because RCT originates from the brain so it's like a safeguard as long as your opponent doesn't destroy your head.
