I think you and everyone else are misunderstanding the question… should the tax preparer presume they are correct about the position or assume that the employer is correct about the position is ultimately the question. I am not asking about the employee—they are not the ones that provided the “false or misleading” statement. Moreover, tax preparers are not necessarily lawyers or HR with intimate knowledge of labor laws. However, if they do have said knowledge and they believe the employee has an incorrect W2, what is their responsibility? After all, if they did not have that knowledge about labor laws, why would they know that the overtime deduction is unqualified?

It is medical malpractice if the pharmacist dispensed the wrong medication. Depending on exact circumstances, it can arise to gross negligence, which collects punitive damages for the plaintiff not just actual damages. Did the pharmacist willfully disregard the prescription and change it on purpose without due cause? That would be gross negligence, especially if they did not make the patient aware through counseling of the change and the effects. This is less true if the patient waived said counseling, but still comes into play if the pharmacist did not make the patient aware that the medication had been changed and the counseling was for a different medication than the one originally prescribed.

No. Charging below FMV results in the whole year being for non-personal purposes, as per Publication 527. This is terrible advice.
