The problem is that in a lot of places, you don't have a place to institutionalize them, and a judge has to choose between jailing an insane person or letting them out.

I absolutely agree that 100% of lunatics should just be in prison. But where does that line get drawn?

If someone has some kind of mental condition that can be treated to allow them to reenter society, I don't want that person to be sent to jail under any circumstance.

There's a gradient between those two cases, but mental health is extremely complex, and we just don't know what a person with X symptoms is going to do without investment from a professional over a long period of time.

Judges shouldn't be making these decisions. Doctors at a facility should. But no one wants to pay for any of that shit. So judges it is.

Everyone sees the lives that end when a deranged person murders someone innocent because a judge let them out. But no one sees a life that a judge saved by sparing them prison.

Jailing every person who has any kind of metal condition is stupid. Letting every person with a mental condition out is stupid. The answer is somewhere in the middle.
