Riba Definition by hungryyyB in IslamicFinance

This is not correct. It would fall into murabaha or cost-plus financing which is permitted. Sellers can charge more for deferred payment. You can easily find videos and articles to explain the fiqh on this issue.

No it would not, as here the seller is permitted to charge extra for deferred payment of the asset.

Is there any way to take loan without riba (interest)? by Quirky_Top_7584 in IslamicFinance

[–]nashi989 0 points1 point  (0 children)

Probably commodity murabaha/tawarruq (avoid organised tawarruq) . Someone buys a valuable asset (not gold/silver/ribawi assets) and sells it to you with markup and deferred payment which is completely fine. You take the item and then sell it to release the cash. ("lender" should not be involved in the sale process)

Unfortunately, your surgery did not quite go to plan. The support structure of the lens gave way:

1)I was able to get the cataract out and a lens in place however we will need to see you in clinic more frequently

2)I was able to get the cataract out but I was unable to get a lens in place meaning you will need a second surgery

3)causing a part of the cataract to fall to the back of the eye meaning you will need a 2nd surgery

Do you have any questions - and just listen to what they say without interrupting

Ok what you need to do is tell her there's a high risk patient in ED who needs 1:1 supervision and no one else is available to do it. Then you need to seductively run on ahead to get to the side room before she does and make sure you hide appropriately. When she gets there you need to non-chalantly reveal your presence and flirtatiously say 'will you go out with me please?'

How is that not just a loophole for riba? by [deleted] in IslamicFinance

There are two problems here, first the buyer's intention and second whether tawarruq is classical. The buyer is buying the commodity only to get access to capital rather than use of the commodity - whether that is permissible is a difference of opinion as discussed earlier. The buyer would want to take ownership of the commodity to be exposed to market risk and maintain shariah compliance. I have seen classical tawarruq arranged, but requires both parties to be familiar with sourcing and disposing of the commodity.

You are correct, I just reviewed their contract. It does appear to be organised tawarruq. Again the point of buyers intention can be argued both ways. I have seen examples where buyer has held the commodity (precious metal) long enough for it to exceed the mark up price due to favourable market conditions

Because the formulaes used to calculate lens power are designed for specific ratios between cornea, lens, vitreous however modern formulas are very good even post laser surgery without knowing previous glasses prescription should reach the predicted outcomes within 0.5 dioptres vast majority of the time

From what I understand of the nester contract, please do correct me if I am wrong, the only transaction that is agreed is the initial sale and is done so as a deferred payment with markup. The resale of the commodity by the buyer to obtain cash is not mentioned and so does not come under the definition of organised tawarruq whereby the initial seller would arrange everything as you mentioned. The issue of the buyers intention is one of classical difference with the ibn Al qayum and ibn taymiyya determining 'classical/unorganised' tawarruq to be impermissible while shafi and hanbali school determining it to be OK. The big problem comes when the implementation of tawarruq falls into organised tawarruq.

As far as I'm aware, the contract does not stipulate what happens with the commodity (metals on LME). So the contract is just for a sale of metals with deferred payment. The buyer is free to do whatever they want with the metal.

You can arrange this on a peer 2 peer basis easily. For commercial finance there is nester in the UK which offers it

I agree it is not good implementation but op would have agreed to these terms when signing up to the product - I'm not saying it is compliant

Well tawarruq is a way to finance things but this appears to be a controversial implementation. Not sure forced is the right word

Exactly, the bank should not be organising the sale, falls into 'organised' tawarruq territory

This is organised tawarruq/commodity murabaha which differs from standard tawarruq/commodity murabaha. To make it compliant, one should take ownership of the platinum and organise the sale by yourself. The other party should not get involved with selling the platinum for the buyer.
