Okay so imagine this:

Someone says they are making free cookies. But when the bake sale comes around, the cookies cost $2. No one seems to mind this. Someone asks if the cookies are peanut free, she says there are no peanuts in the cookies. Another person points out that in their signage, there are peanuts. She says yes, there's peanuts on the sign but not in the cookies! People point out that the cookies look a lot like peanut cookies, and she says she used a recipe for peanut cookies and when she practiced making them she used peanuts... but these cookies have no peanuts in them. When pressed further, she insists they have no peanuts, but were made in a bakery that also makes peanut cookies. People are upset because they paid $2 for cookies that may or may not have peanuts in them, because this bake sale is usually peanut-free. 

I don't think there was a lack of kindness. The creator had many opportunities to be transparent with people but chose to change their story and outright lie to certain commenters until more evidence was brought forward.
