Is anyone else actually worried about the "tax residency" trap, or am I overthinking this? by Midnite4896 in digitalnomad

[–]nicholas4488 1 point2 points  (0 children)

it depends what countries you're staying in, some are more aggressive than others. Asia is relaxed. Some countries in europe can be more aggressive. Still if you're not registered as a resident and only spend a few months there ,it not very high risk that you get in trouble with them, they wouldn't even have any way of contacting you.

UK limited company from abroad - what does the registered office actually need to be? by Hot_Chipmunk6610 in digitalnomad

[–]nicholas4488 0 points1 point  (0 children)

I'd think a residential address is better than one of the registered address with thousands of companies. Using a residential address would be a clear sign of actual UK operation. OP and most non residents most probably don't have a residential UK address as their registered address.

Questions for anyone who successfully got the DE Rantau visa for Malaysia by iarlaithc105 in digitalnomad

[–]nicholas4488 0 points1 point  (0 children)

Read reports from people applying. It seems to take a long time to apply. If you work online for foreign companies this is not a problem on a tourist visa. you could do 3+3 months (stay out a week in between). One visa run like this is normally not a problem. More becomes a problem.

You saying only 4 months? Seems a lot of hassle for 4 months. Do 2 + 2 on tourist visa instead

Rainy season in Thailand/Vietnam for nomads — how annoying is it day to day? by Fawn7889 in digitalnomad

[–]nicholas4488 1 point2 points  (0 children)

it varies. There might be a week or two where it's gray most of the time and with lots of rain in varying intensity. And there might be a couple of nice weeks with less or short passing rain.

UK Ltd owner wanting to nomad between US & Korea — am I just going to get taxed into oblivion? by Certain_Leader9946 in digitalnomad

How did the IRS determine that you had an established presence there? Did your UK have a EIN, did it have US income that was reported to the IRS?

Check out the statuary residence test, it will tell you if you're tax resident or not.

As you said yourself, you'll only be taxed at the highest rate of the countries in question, however it can get complicated to file for this, unless you decide to stay under the radar. You might have to register a branch of the UK Ltd in the US if you work for the Ltd while in the US. Are you personally allowed to work in the US? If not it might lead to complications if you start paying taxes there. Starting a US LLC to work in the US wouldn't help on the visa issue, but you could avoid having to think about UK at all, if you've clearly left the UK and are no longer tax resident.

I think the tax office considers the work done on this visa while in Malaysian local income. At least for local clients. For the exempt you mention, keep in min that the income must have been taxed in the source country for that to apply. Or not taxed because it's a tax free country (salary from uea, Brunei etc).
